Handing in notice while on annual leave

Ok so im on maternity leave until january then annual leave. Is it ok to hand my notice in while on annual leave? My notice period is 3 months and I also have to return for 3 months in order to not pay maternity pay back.

Hope that makes sence

I think so? (I'm an HR manager so I should probably know this but my brain is fried today). Check what it says in your contract and for certainty I'd check with ACAS but I can't think why it wouldn't be okay.

I’ve done it, emailed my line manager on a day off.
It was something like:
Hello name,
Please accept my resignation letter. My last working day for xyz company will be DATE.

Thats great, but my question was more about if i can hand it in while on leave, and still have the leave count as 4 weeks of the 12 i need to complete to not pay bacl my maternity pay.

Yes, assuming your three month notice period counts towards your three months required post mat leave

OP, you need to check what your employer’s maternity policy says about the requirement to repay your enhanced maternity pay if you don’t return to work. My employer has a similar rule and the policy expressly states that the three months (six in my case) starts to run from the first day of your “active return to work” i.e. when you actually go back to the office - so periods of annual leave, unpaid parental leave etc. wouldn’t count. Your policy may be different but it is important to check as there is no hard and fast rule.

normally the 3 months is when you "return to work". either on 3 months annual leave, sick leave etc

so not at the end of your mat leave. So say your due back in april, you cant resign in december and say my last working date is april the 1st, and thats your notice and some more. You have to physically work it.

thats how it works in my company anyhow!
