Am I unfairly treated ?

Here is some history: I had a new manager recently who changed all job descriptions and MADE us sign.

My colleague and I had different job roles with same grade of responsibility previously and she said this is not right and we need to have equal job roles and changed it.

We are still having different duties, but she is expecting everyone to do the same function, however she gave me a task that is physical, not in the job description and my colleague is not required to do it.

Lately, I had health problems and called sick (total 4 days for the whole year). I had surgery couple of years ago, then the issue reoccurred and I spoke to my boss that the additional task that she gave me is giving me extra pain and fatigue. We have been also trying for a baby and during my holiday I had a miscarriage.

Of course I did not want anyone to know about it, but my doctor and have been visiting them for tests and examinations, just now, after the holidays.

After today's appointment my boss requested a medical note that I am not fit to do my job (Overall, I do my job and just 2 weeks ago obtained an award for my work place) and if this is long or short term issue.

I have been suffering from the loss of my third child and also had to deal with physical pains, bleeding etc. and the last thing I want is a dealing with the company HR and stress out.

However here comes my question:

Am I unfairly treated / discriminated due to my conditions and why is my peer not required to perform the same task if we have the same job description?

At the same time I requested to work from home twice a month due to my fatigue, he declined, but he works occasionally from home ?

Any advice will be appreciated, thank you.

Have you given your manager sufficient insights into your conditions and challenges so they can treat you fairly? It could be your colleague has spoken to your manager about challenges of their own which prevent them from being able to do the physical tasks (esp. if it involves lifting heavy objects or people?).

At the same time I requested to work from home twice a month due to my fatigue, he declined, but he works occasionally from home ? you need to formalise your request as a reasonable adjustment tied to a disability. His working from home isn't relevant so it wouldn't be a good idea to mention it.

And just to say, very sorry about your miscarriage, that's such sad news. It's horrible having to discuss personal medical matters with someone in your workplace. Can you seek support from your Occ Health if you have one, so you can discuss it with someone in a medical context rather than with your manager direct.

I have explained the nature of my fatigue, but they seem to be ignorant.

Not too sur about my coalllegue, but I don't even think they asked him to do the same task, double standards.

My mistake not to officially request this, but now I will deal with this.

Thank you so much for your input and advice x
