They calculated annual leave incorrectly

I started a new part-time role in a large organisation a couple of months ago. The contact I signed had pro-rated the annual leave for the year, along with the back holidays but it seemed a lot. I queried this amount twice with HR and twice on an email they confirmed it was the correct amount of leave.

They are now saying it was a miscalculation and the amount of leave available for me to book on the HR system has almost halved.

Given the signed contract and the confirmation in writing, can anyone give a steer where I stand on this? I feel really annoyed.

I work in HR and they have just made a mistake - no case for you to negotiate here.

The contract states ‘you are entitled to 184 hours annual leave in the current period’.

I previously held a different part-time role in the same division in the same organisation and the actual leave was spelt out just like this. Same format, same contract with actual hours I had to take in the remainder of the leave year from when I started. The entitlement stated in number of hours, just like above. This is how they do it. Which is why I queried it as it seemed much more this time round.

You are probably right, and 104 is the correct amount pro rated but it’s just not what I signed up to and had made plans around (both booking flights and holidays and in my head). So was just a bit annoyed and reacting.

Anyways, I’ll get over it all and suck it up.

Sorry flowery you’ll have to find another poster to make pointy remarks and wonky faces to now.

I was genuinely curious on what basis your friend felt there was negotiating room here. But feel free to respond with a snarky remark instead, hope it makes you feel better.

Could you take some of the holidays as unpaid parental leave? Then at least you still have enough a/l to last the year.

I kind of agree with your friend - the company has made an error and that has had an impact on your life because you booked annual leave on that basis that you would still have some days left for other days but it now turns out that you will have a lot less leave than you were led to believe. Your friend is not saying that you are legally entitled to more leave, she is saying that you have a case for negotiation - when there is an error made by the employer, even if they are within their legal rights to correct it, it would be sensible and reasonable to negotiate with the affected employee to minimise any adverse impact of the correction on the employee.

I think OP's position is slightly weaker as she previously worked in the same company but in a different department. It could reasonably be argued that she knew how much holiday would be usual. I'd love to work in a company that gives almost 10 weeks holiday a year

I would take the contract to mean that the 184 hours was for a full time person and you would get this pro rata depending on your hours

Really sorry to jump on thread but some of you may have the answer I am looking for; I work part time - 18 hours over three days (Tues-Thurs). The standard leave for FT employees is 20 days + bank hols so 28 days. My pro-rated leave is 12 days. I think this is incorrect as the multiplier should be 5.6*3 = 16.8 for the year, irrespective of my working days falling on bank hols or not.
I want to check my suspicions before I tackle my bosses about this.
Can any HR bods help? Thanks in advance!

Yes I would say 16.8 days too. Or 100 hours and 48 minutes which should work out about the same.

It doesn't matter what full time hours are as she is entitled to 5.6 weeks holiday so 3x 5.6 = 16.8 days.

Is holiday booked in hours or days and di you work 6 hours a day for 3 days?

17 days, rounded up from 16.8, and any bank holidays which happen to fall on your working days should be taken out of that
