Employee wanting to do Freelance

Hi, I wondered if someone could give me some legal advice (obviously not binding!).

I work in a school in support. I do photography as a hobby and have branched out and done a few jobs self-employed (am registered etc and that's all fine - we're talking a VERY small amount).

My school have asked me to do some photos of an event - can I invoice them from my freelance business even though I'm an employee?

The lady in HR doesn't know and I need to make a decision. I'd like to do it but if this becomes ongoing (if they like my photos) then I'd want to bill it via my business.

Any advice much appreciated.

If the work is to be completed in your contracted hours you would need to book annual leave. you should provide a written quote detailing the rate, hours and any prints that you will be providing, then ask for confirmation by email from the school business manager that you can go ahead. You can then invoice for the work.

I agree with PP, Its whether or not its in your contracted hours.

No, it’s for a weekend sports event and I am not expected to work those days. Any other stuff would be for weekend/evening events.

Ok, thank you - sounds like it’s all okay then :)

As it's very different from your normal job, and is the kind of work where being self-employed would be normal and expected, and a genuine reflection of the relationship between the parties, you'll be fine.
