Temporary acency worker issues

Hello hoping someone can advise me.

I started in Jan 19 on a four week placement believing that an agency was my employer.

My first payslip shows Agency as my employer.

My second and subsequent payslips to the end of the tax year started COMPANY 1 as my employer. Apparently payroll is outsourced. Let's call this COMPANY 3 as all pay related queries have to go through them.

I have had my first payslip for the new tax year and COMPANY 2 is now listed as my employer.

I have been in this placement since early Jan 2019. Same hirer nothing has changed for me.

I don't seem to have a contract with anyone.

Payroll company tell me the employer stated on my payslip will change from time to time and this is normal for agency workers. I've not worked on agency before so unsure about this.

I feel concerned that my employer may change at any time and so might any "contract" (apparently they will email me a new contract for company 2 within the next few days)

Who is my employer? Is this normal? Should I run a mile?!

Company 3 issue all payslips and would issue p60 and P45 if this is relevant.

Help! (And thanks! Hope this made sense!)

Update. Got my payslip today for payment on Friday. Didn't include my holiday pay.

Apparently it's normal to get this in the pay run after your last payment?!

My concern would be that this is a way of them getting around any statutory sick pay or statutory maternity leave/pay obligations, as you need to meet certain criteria of continuous service to be entitled to these benefits.

I had one job for a year but the company kept changing names. It ended up because they were opening and closing companies all over the shop to avoid paying tax and creditors. I ended up with an £800 tax bill because, according to HMRC, I worked for 5 different companies at the same time.

Just be careful of something like that. Sounds as dodgy as hell though!

What are you expecting OP? If you're expecting them to show on your payslip how many days' / hours' statutory holiday you are accruing over time, that's fine and yes it is good practice for an agency to show you the running balance, as they are your employer and it's likely the only document where it's written down formally. Unlike in a permanent employment situation where you have a computerised HR system tracking days accrued v days taken.

If you are expecting them to actually pay you for those holiday days, that is not good practice. The reason UK employees are granted statutory holiday days is to ensure people have time off from work to rest. If the agency pays you those days, you aren't taking the time off! So they are giving an important message that you should use those days off to relax and not work. If you don't use them by the time you leave their employment, then they would have to pay you, but it isn't good practice as an employer.

Sorry forgot to check back.

Having now left the job I accrued holiday not taken before my employment ended. I am paid one week in arrears. So my last week of working for them is due for payment tomorrow.

I'm not getting the holiday accrued but not taken payment until next Friday.

Does that explain it better?

They won't confirm how many hours/days of holiday I have accrued as they say it's based on an average of the last 12 weeks. And they will have to get back to me.

I have no idea what payment I'll get next Friday until I either get a payslip, the money hits my account or they actually decide to tell me.

It sounds OK, just make sure they fully breakdown your salary at the hourly rate agreed and the separate holiday pay on their payslip that they must send you by post or email.

You should know approximately what to expect in your bank account, surely? Based on your timesheets, your hours works is easy to calculate, Holiday pay on top which you'll have to wait for the exact amount.

So I got my last week of working pay last Friday.

Still haven't had my owed holiday payment confirmed to me and haven't had notification that I'll get it this Friday.

I can see them trying not to pay me the holiday owed and also not sign that they've produced my P45 yet.
