Overturning disciplinary

Looking for advice .

Has anyone ever managed to get a disciplinary decision overturned ?

I've to make a decision by tomorrow if I intend to appeal my dismissal otherwise I'll be out of time . I genuinely do not feel it's right , and do want to fight ,but I'm just so emotionally exhausted .

Just looking to see if anyone in the HR sector or from personal experiences have ever seen a successful overturn , or whether it's just going to be a very painful waste of time . Do they ever work ? Or is it a box ticking exercise ?

What have you got to lose... some HR people make it hard so people give in, don't show then you are weak

I have seen many decisions overturned. Definitely try if you think it's unfair. An appeal will be undertaken by someone different to the original decision maker - considering this is often the direct manager, the appeal tends to be based more on hard facts and less biased by personal feelings.

Certainly seen many examples of where the sanction has been downgraded.

Yes, of course decisions get overturned sometimes.

If you've already been dismissed and this happens you might be offered a settlement agreement.

But definitely put in an appeal.

I have seen decisions overturned too. If you genuinely think it is wrong/unfair/overly harsh then give it a go. I would at least lodge the appeal so you don't miss the deadline even if you later change your mind and don't go through with the meeting. If it is overturned but you no longer want to work there you can then focus on getting another job without dismissal on your record. If you miss the deadline you will have lost your chance to challenge the decision.

Definitely lodge an appeal, speak to ACAS...., their helped me negotiate a settlement.....

Yes, I helped a colleague get his dismissal overturned. The HR person involved was sacked, the manager involved 'took a step down' and then left and there were big ructions at head office. The overall manager got his knuckles rapped for not stopping the under manager from bullying everyone.

It was extremely satisfying... Grin
