Can't sleep for worrying, have to tell someone

I gave up work when we had our 3 boys, all under 3 so my other half is the only wage earner.

He is an on the road mortgage consultant. He came home on Friday and told me he thinks that he got caught twice on speed cameras, added together with his other points also for speeding he thinks that he will get a ban but doesn't know for how long. Does anyone know how long you get if your points add up to 12?

I am worried sick to be honest, haven't told him this obviously, he feels bad enough and it's not that he's a bad driver his company groups his appointments so close together that he always has a race to get to the next one.

The worst thing is that even though technically his company is a little to blame, they will probably sack him if he does get a ban particularly if it's a 6 month ban.

Don't really know why I'm posting this but I just needed to tell someone and have no-one else to talk to.

You can ask for leniency if it means extreme hardship ie job loss, I think. It must be so hard when he's being pushed like that.

I do know of a couple where the wife claimed she was driving and "took" the points for her husband. That way he avoided a ban (not that I'm condoning it or anything). Apparantly you get a form through the post asking who was driving the vehicle.

yes i cna give you loads of advice
first get a lawyer

if you are on 12 points oyu are banned unless you put forward excpetional hardship agruments

to do that you haev to show that UNUSUAL harship will ocur - nto jsut loss of a job
if he cn take his boss WITH him to court to testify that they were pushing it( and have made eforts to resolve that ) long term then he will be well equipped
he msut even if he HOPES he will be let off make efforts to fidn oyu HOW undoable hsi life is - th jps will ask him LOTS of qs abotu public ttrasnport - idfferent roles iwhtin th ecompany - leave he could take

in theory 12 points gievs you a 6 month ban mandatory but some benches let you have less if youa re likely to try an exxcpetional hardhip agrument

iff he was cuaght at a VERY high speed ( sa over 110) they may wlel ban " for the offnce a one" menaign thta he isnt liable tot he mandatory 6 month ban and it could be naythign from a day to a month or so - its totally up to them

I'm not sure what counts as extreme hardship tho?

I've told him if it happens that I will just get a full time job doing whatever so we have some cash coming in and he would have to look after the kids but he looked terrified at the thought of that.

Lights flashing don't automatically mean they've caught you - you know that, don't you? I've been flashed a few times and not got points.

Can his company sack him for it??

A colleague of mine was spared a ban in a similar situation, he was due 6 points but they gave him 5 and a hefty fine instead so he could keep his licence and his job. If it comes to it then your husband should get legal advice.

He won't even consider asking his boss to admit they push them too hard because it's part of the job that's accepted.

I couldn't take his points as I don't drive but he wouldn't let anyone anyway as he knows someone who was jailed for doing it.

He wasn't travelling at an exceptionally high speed. He said it was one of the average speed ones which are usually 50 so he set the cruise control on the car to be safe but didn't pay enough attention and noticed on the last one it was 40!

How stupid does he feel?

Don't swap points, it was in the news last week where a 30-odd year old got his 73 year old father who had resposiblilty of care for his equally old wife sent to prison for 3months (in addition to the 3 months he got) for point swapping.

The worst is the waiting I think because he has a company car so it all takes a long time to come through and goes to his boss first.

Probably will know for sure by September...such a long wait.

My daughter's friend's father who is an on the road salesman actually found it paid to hire someone to drive him around whilst his ban was operating - obviously that's expensive but it did work out and he didn't lose his job or customer base.

Also check your husband's employment contract as it may deal with points and what happens in the job then. Some contracts say you're out. Others say we will try to find yo uother work within the company.

If your dh is to be prosecuted he will have to receive a notice in the 14 days after the offences were committed so keep everything crossed over the nest two weeks that there was no film in the cameras!

If nothing after two weks he is in the clear and you can all exhale.

If notice arrives agree with all that Cod says.

bbbeerose, the form that you fill in to say who was driving has a very clear warning about the provision of false information. You sign a declaration that the info is true and so if it isn't then yes this is perjury or attempting to pervert the course of justice more accuratley.

If its a private speeding fine, how long does it take to come through? I heard 2 weeks but is this true?
(I'm not sure if i got caught doing 34 in a 30 zone by a police motor bike thingy on my way to hospital the other week.)

Yes, a criminal offence. Someone was prosecuted the other week - I think it was a 70 year old father who was trying to take the hit instead of his son. Never do it.

If it's a roadside patrol, don't they pull you over straight away if they're going to. I don't think they just 'process you' like the cameras do.

I got 12 points....but,( admittedly with help of good lawyer..it DID cost in that respect ), managed to avoid a ban because of my job mainly...and also my caring responsabilities to ,( then ), 5 small children....didn,t get a big fine either just the £60....I also was an accumulation of small 'oversights' over a fairly short period of time working in a new place I wasn't use to
Am reformed now....
