Can I forfeit my notice pay in order to reduce my notice period?

Just curious if payment in lieu of notice works both ways or is just employer to employee.

Did you resign or were you fired? What’s the notice period?

You only get given PILON if you should be given a period of notice but they want you to leave sooner than that.

I’m not asking to be given PILON I’m asking if a clause about paying in lieu if giving notice works both ways o.e. If I want to leave earlier can I compensate my employer in order to do so.

Legally they can come after you if you don't work your notice but practically is it really worth their while. They can't force you to come in for a month or whatever. It might be worth your while having a chat with HR.

In that case you can just leave if you don’t care about burning bridges and they can just not pay you? Of course, depending on timing, they may also not pay you for the portion of the month you have worked - if that’s a potential issue then you need to ask.

OP - you can ask to forfeit your notice ie I would like to leave early and therefore only be paid to date X, will this work?

But PILON only works the other way effectively

She would be in breach of contract, but as a previous poster has pointed out, it’s highly unlikely to be worth it for the employer to pursue her for it.

Can you just negotiate an early exit? You don't work all your notice period and don't get paid for the portion you don't work. That's pretty standard.

You can’t “compensate” your employer, no. You can ask to be released early, which they may or may not agree to. You can walk out without working notice, in breach of contract. In most jobs they’d probably not do anything, although this is obviously only an option if you won’t ever need a reference from them.
