Flexi working application time limit??

Just wanted to clarify with anyone who knows or has been through this - after the application is put in they have 28 days in which to respond, yes? Is that 28 working days or just 28 days?

Sorry if that's a bit of thick question!

An employer must hold a meeting with you to consider the request within 28 (calendar) days after the date an application is received.

Right, thanks, boss is sailing very close to the margin with this one!! Put my request in via email on 5.6.07!

LLL

Are you sure it was received? Might be worth checking, perhaps another email asking him/her to confirm receipt?

louloulouise · 03/07/2007 09:23

Yes was definately received, he emailed to say thanks and that he would look at it. The deadline is today so I'm not quite sure what to do. I am also currently on maternity so I'm not sure if that affects how they can contact me, I don't have access to my work email.

Thanks for the replies so far!

I'd ask your boss for an update (he might have forgotten about it and be glad of a nudge...)

If nothing is forthcoming by the end of the week I'd contact the ACAS helpline for advice -

Monday - Friday 08:00 - 18:00

Thanks, rang before but couldn't speak to manager, however team leader said she was about to go into a meeting with him and would mention it afterwards and get him to ring me back or she would. Fingers crossed. I mean, I'm only due to return to work from maternity in March 2008 but 28 days is 28 days and I'd rather get this sorted now rather than have it hanging.

28 days from date of receipt, e-mail is counted as received the day you sent it (not the day its read).

This is for them to either say yes to your request or hold a meeting to discuss it further. After the meeting they have 14 days to give you the decision

Just another point worth bearing in mind.

Am I right in reading that you have made a request for flexible working but don't want this to apply until your return from maternity leave next March?

They do have to respond to your request in the timescale mentioned but tbh I would expect them to say that they are unable to assess an application for a change to working arrangements so far into the future at this point.

louloulouise · 04/07/2007 22:03

My boss actually asked me to put the application in as I was currently working the hours I've requested as per a verbal agreement with the previous manager, this manager has failed to pass the info to the current manager and as it's not written in my contract the current boss suggested getting it sorted sooner rather than later (he also processed another request from a colleague prior to her maternity leave in May).

I'm know it's very likely that the application will be approved (I've been working the shifts requested since I was taken on permanently in Aug 06) and he's set a precedent with my colleague (incidentally she would be working the opposite shift to me, pm and I am AM shift, so kind of like a job share). It's just a bit annoying to have hanging over my head and have him deviate from the timescale they provide.

They've still not called back so I shall be ringing again tomorrow afternoon to see what's going on!

Sounds like crossing t's and dotting i's if you are already working those hours, which is good, but obviously they still need to stick to the proper timescale.

Definitely harass to get it sorted and let us know how you get on
