New staff being given different contracts to ours

I work in education. New staff that are joining our dept have been given a clause in their contract that isn't in ours. Am I right in thinking that HR should have a consultation with current staff to inform them of this? Job title is the same. Thanks

They would need to consult with existing staff if they decide, at a future time, to align their in force contracts to the new ones, which is what often happens. They won't need to do anything if the existing staff contracts aren't changing.

In education they probably should have consulted with the unions about changing terms and conditions for new staff. Do you know they didn’t do this?

itsboiledeggsagain · 26/01/2019 08:27

What is the nature of the clause?

I am always adding in new clauses about different policies or recently gdpr. Not a big enough deal to reissue everyone else's contract.

Funkyslippers · 26/01/2019 08:37

The new clause is for intimate care. We currently don't have this in our contracts and don't undertake it but the new staff have to

But no one is trying to change your terms and conditions?

AppleKatie · 26/01/2019 08:41

I don’t think they have to consult you unless they want to change your contract.

Isleepinahedgefund · 26/01/2019 08:57

New starters where I work are employed on substantially less favourable contractual terms than I am, relating to leave and sick pay. They don’t have to consult existing staff - only if they are changing your contract.

Mobility Clause in an academy? If so it is standard.

Lazypuppy · 26/01/2019 17:14

But they aren't trying to change your t&cs, t&cs always change over time, i have a different contract to people who started 5 years before me etc

Not sure what your issue is?

HermioneWeasley · 26/01/2019 17:15

Why would they need to consult with existing staff about contracts for new starters?

Funkyslippers · 27/01/2019 09:42

Just what someone in our team said. I didn't know whether to raise it with the Union but I won't now. Thanks

The union should have been consulted so there’s no harm in raising it with them just to check, if you are concerned for some reason.
