Annual leave when working notice, help!

My DH has just been accepted for a new job. The job he's in now has been awful and stressful for him. His boss lets him know that he doesn't like him and can be quite an arse to him. They're understaffed because the boss won't hire anyone else and most of the workload falls on dh. He handed in his resignation on the 12th. He has to work 4 weeks notice according to his contract, but he has 3 weeks annual leave left, which he would like to use in his notice to have a break before the new job starts. He's had a meeting with his supervisor and his area manager today and they said that they want him to work four days over his holiday time. Are they allowed to refuse any holiday time? Dh said his manager has told him it's at his discretion. They've been using bullying tactics and trying to get DH to stay longer, but the truth of it is he's really fed up with the job and would just like to leave as soon as he can.

Tricky - I suppose they are allowed to say when he takes holiday but it does seem daft to deny it if he hasn't got a chance to take it after that. Did they say they'd pay for the days (as in holiday pay when he leaves).

sounds right, I had this and was paid in lieu.

Also, if they need him for cover etc. They’re not really being unreasonable. And 4 days isn’t too bad.

LIZS · 14/12/2018 14:28

Yes they are entitled to refuse leave requests. Any balance should be paid with final salary.

Artmum1234 · 14/12/2018 14:45

Yeah they'll pay him the four days leave that he won't be taking. I guess your right, four days isn't bad, if they could have refused the whole three weeks! Thanks for the help

So he is getting two weeks and one days leave? During a four week notice period? I think that is more than generous if so and yes they could have refused it.

DragonMamma · 14/12/2018 15:59

Agreed it’s very generous. It was a big ask to use 3 weeks leave in a 4 week notice period!

Is it 3 weeks though as in his holidays are Jan to Jan and not Apr to Apr....we have to take off 2.5 days per month for the annual entitlement when someone leaves

How many sick days does he have?
