Notice Period Query

I may be leaving my current role for a new job and was double checking my notice period in my contract. I think I only have to give 4 weeks but the wordings a bit woolly (or not and I'm overthinking it!).

It says "1 week notice will apply on either side during the first 6 months of employment. After probation the notice period will be 4 weeks notice and 1 additional weeks notice for each further complete year of continuous employment, up to a maximum of 12 weeks."

I have been here for 13 months, assume I have passed probation as this passed by without a word Hmm and I am still here. So I am reading this as 1 week up to 6 mths, 4 weeks for the next year after that and the extra week wouldn't kick in until I had been 1yr and 6 mths in the role? And not 1 week to 6 mths. 4 weeks to 1yr employment and then the extra week kicks in? Not the end of the world if it is 5 weeks notice but would be useful to know if I am reading it wrong. Thanks in advance

I see it as 5 weeks. You've already passed 6 months.
So it's 4 weeks plus 1 week for each year worked = 5 weeks

I think it's four weeks. The additional week is for each further complete year of continuous employment. Therefore, I think it's four weeks from the end of your probation period until you have completed two full years (that is, the first year, including probation period, followed by one further complete year).

I would say 4 weeks notice as the extra week is for each additional complete year.

Your employment doesn't start from the end of your probation period, it starts when you joined.

Thanks for the comments - it is the "further complete year" wording that I was unsure of. As to whether that kicks in after 1 full year or as commented after 2 years. I will clarify with HR if I do decide to move on. Thanks Smile

You'd have to have completed the year up to the anniversary of your official start date (as per offer letter or contract of employment) to add the extra week, so as you've currently only done 13 months, it's still 4 weeks. In a further 11 months, that's when it becomes 5 weeks.

Btw, probation isn't always marked with a fanfare IME Grin but you can take it that at 13 months you've definitely made the grade!

I would say it is four weeks. If it said " one additional week for each year of continuous employment" then I would have said five weeks.

But they do say "for each further". So further than what? It can only be further from the probation period, so if you had completed probation and then done a year, it would have been five weeks.
