Hi, any advice please?

My mum has been off sick for 4 weeks with a bad knee. (She couldn't walk) It has been diagnosed as osteoarthritis.

She returned to work last week to her job in retail and only managed 4 hours before nearly collapsing in pain.

Due to her works sickness policy the first 3 days are unpaid the SSP kicks in. So she lost 3 days pay when she originally went off sick and has just been told she us losing another 3 days pay now because she returned for those 4 hours.

There was no return to work interview or phased return or risk assessment.

Does anyone know if she can appeal the 2nd 3 days no pay period?

Those periods of sickness should be 'linked' according to .gov site

You can get £92.05 a week Statutory Sick Pay (SSP) for up to 28 weeks.

You getSSPfor the days you would normally have worked. It’s not paid for the first 3 days you’re off, unless you’ve been paidSSPwithin the last 8 weeks and are eligible for it again.

If you have regular periods of sickness, they may count as ‘linked’. To be linked, the periods must:

-last 4 or more days each
-be 8 weeks or less apart

You’re no longer eligible forSSPif you have a continuous series of linked periods that lasts more than 3 years.

@dementedpixie that's really helpful - thanks! Her manager sounds useless - no hr knowledge and unwilling to go out of his way to find out! I'll look at the link.
