i started back at work at the beginning at of march and when i started i told my boss i didnt want to do much and i had a problem with anxiety

ive done lots of cover for my boss a total of 56 extra hours in a month and it knackered me to be honest but one of the girls had lost he rgramps and was gutted so i stepped in and did my best

im one of two part timers, the boss has a girl off on maternity and the girl who lost her gramps has come back two days only so there is only one girl working full time

this week will be the 13 th week ive worked for her and i was signed off with stress a fortnight a go and ive been signed off again for two weeks and prescribed antianxiety/depressants

im only worried coz the girl who lost her gramps she was off for around 15 weeks on and off and she was on about sackinngher because she wasnt fit to do her job and she had grounds apparently ????

no she bloody well cannot.

melsy · 18/06/2007 14:45

we wont let her !!!!!!!!!

I would definately call CAB, as this will give you some amunition info if she chooses to get nasty. As you have a gp's note it is legitimate. I know how you feel with this, but youve given her no grounds or eveidence that you are unfit for the job , as youve been working really long hours for her up till now. As you said you were straight up with her.

Your illness is probably covered by the DDA (disability discrimination act) so check that out on the ACAS website.

The company you work for should have a sickness/paid leave from work policy which she would need to follow.

Make sure you take care of yourself!

chocolatekimmy · 18/06/2007 21:12

Check your absence policy first. They should have clear rules as to when disciplinary action can be taken. Often it is based on number of occasions so for example you may be off for 3 occasions and get a verbal warning then another 2 times and a written, all the way up to dismissal.

Each time it has to be fully investigated. Most absences should be counted (unless its disability or pregnancy related) as an occasion for the purpose of disciplinary.

Does though depend how long you have been there, no protect for unfair dismissal for under a year unless its a discrimination like race/sex etc.

Not sure what you were expecting by telling your boss you didn't want to do much - do you mean work or hours? Obviously you have a duty to go to work and fulfil your duties. If you aren't well enough then you should take sick leave.

I hope you are recovering, its not an easy illness but you will get better with the right support and help. If you go back they would hopefully put in measures to prevent stress at work.

DDA is complicated, has to last a year or more and have a substantial (more than minor or trivial) and adverse affect on day to day activities. Let me know if you want more info on that.

I would suggest that you keep in touch with them, letting them know how you are and what the GP is saying and what treatment you are undergoing etc. Keep up communications with them

RuthT · 18/06/2007 21:28

Have people at my place covered by dda and it is less than a year.

It is a tricky bit of law

RuthT · 18/06/2007 21:29

I second chocolateskinny on keeping in contact and would add that you do intend to return as soon as practicable

chocolatekimmy · 18/06/2007 21:36

Its for an illness or condition that lasts for (or is likely to last for) a year or more. So if someone had an arm amputated, they would be covered from day one as it is definatley going to last for more than a year.

Employers have to be cautious with things that could reach the year mark.

Cancer, MS and HIV are covered from the point of diagnosis - regardless of whether they have any symptoms or not.

What are the conditions at your work that are under a year?

i meant i didnt want resonsibility or lots of long hours ive ended up being the oly hairdresser on floor on thurs night and cashing up and locking up on a thurs and working alll day on a friday

i also covered loads as i was led to believe if i didnt do it my job may be in jepordy in directly of course

i have bben full and frankl about my illness and as i say i told her before i started work iwas still having attacks and i didnt want to do mor than 20 hours

this is my second lot of 14days sick note and ive been prescribed antianxiety/depressants

as far as i know she hasnt disciplined anyone for being sick b4 but im concerned because this week is my 13th week she may say when i go back look we \greed twelve week trial you've been off four weeks of that so im sorry does that mean i can be 'let go'

i didnt ask for the responsibility i was told i was cashing up and locking up as i was the only one who could do it

when i took the job i specifically asked not to have any responsibility within two weeks i was landed with it

'because i used to do it i'd be fine'

but obviously im quite high up and i charge alot of money for my services 'oooh get me' so obviously i have to provide a great service and totaaly cannot do that at the mo

The other thing is Booby, how are you expected to deal with customers in a "proper" manner when really you feel like you do?
All it will do is make you bottle up your feelings more and when you go home you'll feel worse!

I'm sure your boss must understand that to some degree.
