Unfair dismissal??!

So a bit of a back story, I
Put in a formal grievance with my employer during maternity leave, they reduced my hours and nobody else’s I have in writing that they contacted Acas and they were allowed to do this as we have no contract at work..! The letter was dated 7/7/18 so I know I can
No longer pursue this case I think? Is that correct? As it’s longer than three months! I just went along with what they told me as I needed a job and was scared to take it to early conciliation with Acas! So they never increased my hours I went back to work two weeks ago and the atmosphere was slightly frosty, I felt like I wasn’t particularly wanted there and I definitely went down in the “pecking order” since being back. The I was offered another job which means I can work more hours in the day and thereofore work less days a week. I asked my manager how much notice I need to give before I leave ( I don’t start my new job for a few weeks yet) she replied “you might as well leave now” was I effectively sacked? This was Friday I know she was bitching about me as soon as I left I’m waiting for a reference and all of my documents from them so I don’t want to rock the boat as such, I’ve spoke to someone who has advises I ask for
My work terms and conditions but I know we don’t have any I’ve never been issues with them or a contract! Shock

As you have new employment I would put it behind you. They don't sound like a responsible or equal opportunities employer and they probably did push you down the pecking order, which was not good, but you've moved on now.

Lesson learned, please ensure you are always issued with a contract of employment in writing. Any employer unwilling to do this, or who conveniently forgets to do this within 3 months (or ideally before you start working for them) is not operating to good employment practice.

No I don't think you were sacked, you resigned and were told you did not need to work any notice. I would probably have given them a week's notice as this is what you are required to do if no contract. So maybe you could ask for a weeks pay in lieu of notice if you think it is worth it.

If you mean were you constructively dismissed because of the earlier reduction in hours, then I think you have left it too late to complain about now and I don't think you would succeed.

Agree with above, let it go and make sure you get a contract next time.

Thanks I have requested payment in lieu on the advice of Acas! Thanks for the advice, I do have a contract in my new job! Smile
