Next steps when employer only willing to pay ssp?!

Hi!! I had an injury in work a few months ago causing a hernia. Only missed 1 day which they paid me for. They were suggesting i would have to go on sick but then they were advised to put me on light duties. Injury was put in accident book. Also had a letter stating hernia was caused while in work thats why ive been put on lighter duties. I've now had a date for my op. I'm going to be off work for 2-6 wks.

They're only going to pay me ssp which i know they're entitled to do.i was just wondering what advice others would give if i decide to look for more money?? Is that the right thing to do?? Or just suck it up nd get on with it??

£92 wk isnt enough for me and family to live. Ive been in job for 9ish yrs hadnt missed a day in 7yrs. But ceo can hardly look at me.

Hope im in right place for some advice.

You need to see what other benefits the family might be entitled to for that period of time. If your contract states SSP only then unfortunately your employer isn't obliged to pay more.

Can you sue them for loss of earnings?? Were work to blame or did you fail to follow protocol? Do you have a union?

Oh, I missed that the injury happened at work. I wonder if it has to be reported to riddor as there's a hospital stay involved?
Best to seek advice I think.

I understand they're not obliged to pay but just they're atyitude has been poor towards me, practically say how do they know i did in work?

Im just wondering about compensation for loss of earnings?? Where to i go for this kind of advice??

We fit kitchen worktops so its a bit of a grey area for lifting as most things are heavier than 25kg. I followed all protocols.

You could only claim compensation for loss of earnings if your employer negligence caused the injury.

If you think this is the case, consult a solicitor

How do they confirm that this was caused by work, is it a risk you will always run with repeated lifting or that particular type of work. Do you think they were responsible or negligent. Do they have risk assessments, their own guidelines and protocols that were followed. It's hard to claim for loss of earnings if it wasn't negligent. Could you look at other benefits as suggested.

I had a letter to say i did it on site and they were putting me on lighter duties. They have generic risk assessments but this particular time we were carrying it up 2 flights of stairs then had to wait holding it while they took a door off as it didnt fit. I dont thin they have specific protocols they estimating how many men they need.

Maybe its not worth it. I'm just find it hard to accept they attitude of not really caring and making out as if i didn't do it in work.

Are you an employee? Make a claim against their Employers Liability Compulsory Insurance. That's exactly what the policy is there for.

Hmm. Has a specialist confirmed that it was caused by your work's negligence? If so you can sue. But I think it's a bit of a grey area as hernias are common.
