Hi all. Could anyone advise me on what my chances would be for constructive dismissal. I have been on suspension with pay for a year while investagation into gross misconduct continues. I heard nothing for 9 months from suspension and only got my investagtion meeting 3 weeks ago. I am considering moving on to another job and wondered what my chances would be of winning constructive dismissal claim . Many thanks for listening

Update folks. Got cleared of wrong doing in July by disciplinary panel and also my grievance was upheld by a separate panel..still waiting for a return to work date and still on suspension with full pay nearly 2 years later.

I know It will be hard to go back but feel I have to do this and hold my head ..it has been a very hard 2 years and felt at rock bottom at times . Just proud of myself for not walking away and fighting this all by myself..the grievance resulted in an apology with lots of excuses as to why taken so long. Which is unbelievable really as still haven't received a return date yet..I believe they just don't know how they are going to place me back in with those that made the allegations so easier to pay me to stay at home.

I am absolutely amazed that an organisation has suspended an employee for 2 years on full pay. The impact of that on the employee, their colleagues who made the allegations, the cost to the business etc must be huge.

Glad you got it sorted in the end though.

Why should I not go back and hold my head high when I did nothing wrong and had my name cleared..I have been In this job 17years and why would I be worrying about colleagues that tried to get me into trouble to save there own backs..I told the truth throughout whole process and surely this gives hope to others going through same situation..if when I finally get back I feel I cannot work there anymore I will ask for a transfer

Thankyou MT2017 for seeing my reasons and understanding..was such a relief when got letter in July saying my name was cleared of gross misconduct..thought i would have been back into my job by now but they still haven't arranged a return date for me yet. Pay still continuing which I understand aggravates a lot of people ..this is not my doing and I have to just continue to wait for them to update me.

Completely in the dark as to what they will do now Katherine as believed once disciplianry completed in July and was told id be informed of a return to work date which hasn't happened yet.

@redmaggie - aren't you concerned that if they've done without you for the last 24 months that it says something about the job. Maybe they are struggling to find anything for you to do, which is why this is continuing to drag on even since July when they gave you the outcome of the investigation.

If you've effectively been completely out of the workforce for 2 years and counting, you may find it leaves a gap in your skillset compared to others in your profession. A lot can happen in two years.

Hi daisy..someone has been covering the job on a temporary contract so my job still there. Not a rocket science job so after a day would feel as never left if you get me..
