We were sold to another firm. We received a letter from new employer confirming TUPE. We’ve to get new contracts. Can new employer change our terms in their new contract so hours, holidays etc?

As far as I can recall, you transfer over on your existing terms and conditions, and then, (with appropriate notice) hours etc could be changed.

I would not have thought that reductions in holidays could be carried out.

You don’t have to, I was TUPEd about 5 years ago and I’m still on my old T&Cs. However, if you want a promotion it’ll be on the new terms and the company might try and persuade you over with some good terms packaged in with rubbish ones which has happened to me in a previous company.

I have been through a TUPE, no they can't. Unless you sing a new contract. Don't sign ANYTHING before running it past your union rep....if you have one. If not take it home a thoroughly read it before signing.

We were TUPE'd some of us stayed onthe old contracts but any change in hours or job role meant a change of contract. Two years in and they are enforcing chages in overtime beefits/shift patterns to people regardless of which conttact they are on.

My experience of TUPE is that it means jack shit! :(

They should offer you equivalent or better terms in your new contract. Under TUPE you cannot have a negative change, even if you agree to it.
