Both jobs want original MATB1 to process mat pay

I have two jobs and both jobs state they need the original MATB1 form. My midwife is only allowed to issue one form. The employer that currently has it says they will only return it if I am not eligible for maternity pay. What can I do?

You're only eligible for state maternity pay once though , what about contractual are you eligible for both jobs for that ?

Presumably you have advised your second job that your other employer has it. What reason are they giving for not accepting a copy? Do they doubt its veracity?

There is nothing stopping an employer accepting a copy - clearly people might have more than one job, or might use the MATB1 to access other benefits like free dental care or prescriptions or whatever. A copy should be fine.

The HMRC states I am eligible for SMP from both jobs as long as I meet the eligibility criteria. My main job gives me occupational mat pay and I meet the criteria for SMP for second. However, HMRC do not give guidance if both need to keep original after seeing it or not.

The second employer states a copy is only acceptable to give notice of leave and not valid for SMP purposes. I have sent it to them and now they state they cannot return it and pay me SMP. My main employer now also states that although they have seen the original they need it back.

Refer them to HMRC guidance - a photocopy if the form is fine www.gov.uk/employers-maternity-pay-leave/records
