Secondment and termination

Hi all,

Am currently on a secondment which isn’t working out, am considering lodging a formal grievance over the way something (an issue with a colleague) has been handled. Am considering going off sick because it is really affecting my ability to work and my MH is suffering.

The contract for my secondment is between the organisations. It only mentions their ability to terminate the contract for disciplinary offence. But there is nothing mentioned about what happens if I want to pull the plug. Silly me. I should have asked.

Does anyone know how these things work? What’s the best thing to do?

I would talk to HR and ask them for a copy of your current contract

Thanks, do you mean my main employment contract? As I say I checked the secondment agreeement - no mention.

I wound imagine that for situations not covers in the secondment contract, yiu woukd defaukt to your main contract.

If there’s nothing specific in the secondment agreement then you don’t have the right to terminate the secondment and just opt to return to your substantive role. Your best bet is to speak to the relevant people (your substantive line manager, your secondment line manager, HR) and ask the question.

It would be difficult to include a clause which says you can change your mind about the secondment as presumably your original job has been filled by someone else and they wouldn't have a role if you decided to come back early?

I would speak to them and ask if you can just go back to it rather than spend time on a long drawn out grievance or go off sick which isn't in anyone's interests.

How long do you have to go?

I’ve a long while yet.

Yes am very mindful about the person who has stepped into my role.

Have had a meeting with the director and think things are going to be resolved. Not enjoying it here overall, but should be hopefully able to stick it out/learn the new skills and come back after my full stint which will look a whole lot more credible.
