Paid weeks v annual salary

Can anyone advise as I think my employers are taking the @@@

My contract states
Paid weeks 43 weeks (38 weeks term time + holiday pay)

annual salary
£1200

Monthly pay
£ 100

I understand that I should work the 43 weeks at £100 per month as stated, I always end up by working holidays too - I have been told that I should work holidays otherwise my small salary would be smaller I.e. reduce it by 43/52 as I am only contracted work 43 weeks a year and am paid over 52.

Please can anyone advise? I can’t really afford to work for nothing in the holidays as I see it. Who is right?

If it’s a term time only contract plus paid holiday, then that’s what you work. If it’s 38 weeks over the year with your employer asking you to be flexible about when you work, then you could work in the holidays if you get time off in lieu at another time. Or pay.

If you are asked to do inset days (assuming this is a school job) they need to ensure these are paid. Why do they need you in the holidays? The pay being calculated over 12 months is purely for payroll admin and doesn’t alter your contracted hours. If you work extra, get an hourly or daily rate calculated. They can then add this into your payment that month if you work above your hours and/or 38 weeks.

I'm assuming you have contracted hours per week and you work the same number of hours in each of the 43 weeks?

You are only being paid to work 43 weeks out of 52, just because the payment is spread over 52 to make their payroll easier doesn't mean you have to work 52.

As the previous poster said, if you work more than 43 weeks (ie during the holidays) they should either be paying you for those additional hours or giving you the time in lieu to take off during the other 43 weeks.

I thought so. I am a mug! Yes I am school support staff and they have a rep for getting staff to do unpaid overtime.
One staff member thought that it was correct otherwise my 'salary' would be 100 x 43/52. I thought that was wrong!
