New contract - new rights without knowing

I worked for company for 5years. My old contract stated I am eligible for holiday pay-however, after I came back from maternity leave I started working 16hours a week and signed paper stating I’m changing hours (there was no details about holiday pay or sick pay). Now I got sick thinking I will be paid- but I didn’t get paid. I never seen my new contract neither I signed it... I just seen one paper talking about change of my hours. What are my right ?

You seem a little confused about holiday pay and sick pay. They are different things. You don't get holiday pay when you are sick.

Your employer cannot change your holiday or sick pay conditions without telling you. If the paper you signed did not mention them your old contract still applies. But, just to repeat, being eligible for holiday pay does not mean you get paid when you are sick.

I am ne confused. I was just writing in hurry. I singed contract 5years who stayed I’m eligible for sick pay. Year ago i was changed my work hours as well as a role. I didn’t sign any new contract. Just letter agreeing to my new hours and role, but when I called HR today they said my new contract states I’m not eligible to sick pay since starting a new role.

I don’t think it’s right my sick pay changed without me knowing or signing anything.

Well did the paperwork you signed say that?

PatchworkElmer · 16/08/2018 19:24

Ok, no details- fairly certain that’s illegal. Take in your old and new contract and show them.

Lovelyivy · 16/08/2018 19:30

The new paperwork didn’t say that. I signed only a letter saying I am changing my hours and role. My company is extremely unorganised and everyone is acting like it’s not a big deal. Not sure where to go from here. I requested to see a new contract (that HR said I signed - I’m 100% I didn’t) and I’ll take it from there I guess

It could be that the new role has different terms and conditions, you've said twice now that it's a new role.

prh47bridge · 16/08/2018 19:57

Yes, the new role could have different terms and conditions but the OP's company was still required to tell her of the changes.

Where I used to work the rules around sick pay was that you had to have a certain amount of days off in a row to qualify. If you have reduced your hours to 16 (I'm presuming this is 2 days of 8 hours) and this applies where you work, then this a probably why. Your original contract or your employee handbook will state hwyl you qualify.

Jakethekid · 16/08/2018 20:13

State how you qualify * apologies for spelling mistake

My new contract no sick pay in the first year. How long have you been on the new contract ? Ask for a copy of your new contract and terms and conditions

If you've not been issued and agreed to new terms and conditions then they don't apply to you. If you've had a letter stating new hours, then that is a contract variation, and it means that element of your contract was changed, but the rest remains unchanged.
