nanny job finishing now pregnant will i get maternity benefits?

hi, i am full time nanny, and since child was going to school in august thought i would leave,and start up own childminding business, but now i am pregnant,(3 months) just wondering if i will be entitled to maternity pay, i wont be doing the chioldminding now,my boss will only need someone in for after school now. there is nothing in writing but now boss says i can leave end of july!! have i done myself out of a job and maternity pay, would be grateful if anyone knows or been in this situation thanks

I think it would depend partly on how long you've been employed with them. I'm ending a contract end of September and due a baby in mid-October. I wonder if I'm entitled to any maternity pay or not. I work v part-time but even so the 90% pay would be more than the SMP.

As a nanny you are self-employed so can't get maternity pay from employer, but can claim it from the gov if you are up to date with your NI stamps.

F&Z, I don't think all nannies are self-employed. I did a nanny-share with another mum and I used to pay the other mum a proportion of NI & tax for the nanny.

40nanny - I'm not a nanny, but in a similar situation, i.e. maternity leave just at the end of contract.

hi , i have been with the family over 12 years!!, i am not self employed, but since my circumstances have changed,been pregnant and wont be doing childminding till well after my baby is born now.

To qualify for SMP you must have 26 weeks continuous service by the end of the 15th week before your baby is due. If you leave your job after the 15th week before your baby is due, you will still be entitled to SMP.

This of course assumes you are an employee & not self-employed

If you don't qualify for SMP, you may be able to get Maternity Allowance

i was going to work till midd August which would have meant it would have been after 15 weeks, now boss had said finish end of July which will be under 15 weeks before baby is due!! i feel this is not very fair after been there 12 + years

I got in a terrible muddle when i was in the same position and am still evidently in the same state of confusion

but I rang the NI people and they are really extremely helpful indeed

I had not been paying NI but somehow managed to back pay enough to qualify for something or other

they were jolly kind about it

yes all National insurance is up to date, think i will go and see citizens advice tomorrow, or job centre, do you still get maternity pay even if your not going back to your job after baby born?

there was no mention of maternity pay or redundancy pay, as i had volunteered to leave,when i said im going to be out of a job now , she said she wouldnt be paying me as much now anyway , and just needs someone after school which is understandable

I left my nanny job in December to go on maternity leave.
As my job aas very part time and my employer didnt pay m much I was paid maternity allowance from the job centre.
Whilst on maternity leave I was made redundant as the children are now all in full time school and Im no longer needed so they paid me redundancy money.
Maybe you could try asking nannytax or similar?

If your employers do pay you maternity pay as a small employer they will be able to claim back the cost of statutory minimum maternity pay from the Inland Revenue. It's then a cash flow issue for the employer - when we paid maternity pay to a nanny the cash came back from the Revenue really quite quickly. Nannytax sorted it all out for us. If you mentioned this to your employer would you be able to come to some "arrangement" with them?

if you have house insurance employment issues (discrimination, not sure about redundancy) are dealt with under legal cover and so you might be able to get some help there perhaps?
