Conditional pay rise after return to work

I'm aware of a scenario where one of my direct reports may be offered a pay rise after her return from maternity, but conditional on the number of days worked. In short, if she works 3 days a week then her annual salary will be X, but if she works 4 or 5 days a week then her annual salary will be Y (where Y is greater than X, of course).

That doesn't feel right to me, but trying to Google that so that I can get advice from gov.uk, ACAS etc is incredibly difficult, so I wondered if anyone has dealt with this scenario before, and where I can get advice?

Importantly, I'm just after referrals towards official responses (if they exist), as although I value opinions, I must have the 'legal' or official advice to refer to.

I'd ask for this to be moved to the employment board. You'll get more responses there.

Just to clarify - X is not the pro rated amount of Y? Y is more than the equivalent of X? If so then my "feeling" is that if she chose to return 3 days a week she would be being treated less favourably than if she worked 5 days a week and if her decision to only work 3 days a week is due to childcare then it could be sex discrimination. BUT I'm not sure tbh and this is just my feeling.
