1 week notice query

Hi

I have a new job and trying to hand in my notice to my current employer (within the hospitality trade)

My contract states I have to give one week notice as I am under 2 years service. I have tried to hand this in yet my manager has stated I need to give 2 weeks and won't accept 1 week as it'll be a breach of contract if I do.

New employer are wanting me to start ASAP.

Any advice?

Just hand in your notice, and if he comes back with breach of contract, tell him to read the contract which clearly states one week's notice.

Photocopy your old contract and give him it with highlighted notice period and tell him any action against you and this evidence will be used if needed.

Take a photo/screenshot of the relevant page of your contract and email/text it to him. Then re-confirm in the same email/text that your final day of work will be X. Then don't turn up to work after that.

Even if your manager was right, the worst that would happen if you did not give 2 weeks notice is that you wouldn't be able to get a good reference from your current employer. Agree with other posters - photocopy your contract, highlight the relevant section and state that you have given 1 week's notice as required therefore, notwithstanding your manager's refusal to accept it, your last working day will be 1 week after you tried to hand in your notice.

Thank you all. Ended up going back with my contract which clearly states one week for under 2 years service. He eventually backed down with reluctance after he saw it himself.

Sorry forgot to add, he backed down and accepted my resignation letter therefore I'm leaving next week (mini yay!) Grin

Yay for you. It is good when employers imposing nasty contracts get bitten on the bum by it. It's fair enough to have a 1 week notice period for the first month - sometimes you just know immediately that there has been a terrible mistake - but a contract like that for the first 2 years sounds more like they want to keep their labour force as disposable as possible.
