Sent home sick

Posting for a colleague.

Colleague was off work with a stomach upset. Colleague returned to work thinking they were better but came down unwell again almost straight away. Our line manager sent colleague home.

Colleague is now going to be disciplined by line managers manager for failing to return to work!

Where does colleague stand as regards employment law?

Seems a communication error. They did return to work. Are you sure you have the full story?

As a manager I never send people home, it has to be their decision

Can I ask why? It seems a caring and considerate move for a line manager to send an obviously sick employee home. Some people will try to soldier on even when it isn't really in anybody's best interests so taking the decision to send them home would seem to be part of a caring manager's role? Duty of care? And also duty to clients/service users to not have a sick staff member working with them so I'm genuinely puzzled by your comment.

Nope, line manager has told their manager the situation. Employee had followed all procedures but was sent home just before their shift commenced. Employees shift was not covered which resulted in loss of money for the business. Employee will face disciplinary when they return to work.

Just to be clear we work for a very large organisation. They do not pay any company sick either.

If she didn't work her shift, she didn't return to work though - it's not just turning up in the building, unfortunately. Are you sure she is not being disciplined for not calling in sick (which would have given them the opportunity to cover the shift) rather than not returning?

Colleague had turned up for work and then had a reoccurrence of the stomach upset. Colleague had thought they were over the sickness. It was line managers decision to send colleague Home. It seems a little unfair that employee had gone into work and then this all unfolded.

I think you've not got the full story. You can't discipline someone for not turning up to work when it's easily proven then did. Either by other colleagues who saw them or the manager confirming it. Whatever they are being disciplined for it's not as you're thinking.. Confused
