I am hoping somebody in the know can give me some advice here.

My DP is currently paid an hourly rate and receives his pay on the last day of each month. His wage includes all working days every month so his salary varies depending on how long the month is.

His employer has decided to change this so that he is now been paid a fixed monthly fee. They have set his fixed monthly days at 21 days per month. He has worked out that he thinks he is now being underpaid by 0.75 days a month.

For completeness, he gets 25 days holiday plus bank holidays.

Can they do this?

12 months x 21 days = 252

There are 253 working days in 2018 (plus the 8 public holidays) Mon-Fri.

So actually, there are 261 Mon-Fri days in 2018, as I'm guessing the 21 days/month that they are paying him includes any months with public holidays in (ie they won't pay those in addition)?
Therefore, yes, it seems that they are underpaying him 9 days this year, or 0.75 days/month.

That is really helpful to see how you have worked that out. I will pass the information onto him.

I think that they should be paying him for his bank holidays because they always have previously and his contract states 25 days annual leave plus 8 days bank holiday. But I'm not hot on employment contract law so could be wrong.

Thanks Evening. More people have raised it as an issue so it is being looked into.

Apparently they made the change in April but people have only noticed from their may wage. Probably because April had 21 days and May 23. All in all it's a terrible way to treat staff as they only found out about the change when they queried their lower pay.
