Can the council do this to staff ? Upset.

I currently work as a nursery nurse for my council. I started off as a supply person in 2015, I worked most weeks so therefore got a wage every month. I secured a temporary post in one school 19 months ago.
Due to our council moving teachers into the schools and creating a senior nursery nurse post there will be vacant hours to fill in each school. Head of education told us current staff would be offered extra hours plus jobs would be advertised.
My current contract expires next month and I was led to believe i would be continuing after the summer with the possibility of increasing my hours.
On Friday the council advertised for nursery nurses due to the teachers coming out/senior promotions. All as permanent, just says a variety of hours available in every school. Every school is listed including mine. I was not told it was going up by my headteacher.
Has anyone had something like this happen ? Is it possible my contract will be changed to permanent or will I have to reapply for my own job ?

It sounds like you will have to reapply for your own job. But with the security that it will be permanent.

Yeah; you need to reapply. I thought they had to advertise posts... maybe not, but if they do then they're just following the rules.

Yup, you'll need to reapply. My husband recently had to reapply for his own job in the council. Thankfully he got it. Good luck!

My hours are seperate to the post/hours left by the teacher leaving the nursery.
If they are going to merge my hours with the teacher hour post shouldn’t they have had a consultation about it with me ?
2 days ago the deputy arranged for me and her to go on a training course in October ! And the head authorised it, why would she do that ?

I had to apply for this post, I wasn’t just put there from the supply. I went through interview and checks for it.

As you are on a temp contract they do not need to renew. Plus it saves them money to not to pay temp staff over the holidays.

I had to apply and was successful in the job which I had been doing for a while recently on supply. Until you have a permanent contract they have no obligation to keep you on.

No, because you have a temporary contract that is about to end.

I get paid over the holidays.
There will be a lot of staff feeling the same as me as every school is listed and no one was told.
I’m going to speak to my head about it on monday. Thanks all, I Just wanted to get some opinions on it all !

But if your current contract expires next month they will want to start your new one in September so they don’t have to pay you in August.

Opinions don’t really matter in this situation- facts do. And the fact is if you’re on a temporary contract you have no automatic right to a permanent job or continuation of hours. You need to apply like anyone else. However, your experience should stand you in good stead to be considered for a permanent post.

Pottering the initial contract ran until June28th 2017 (term end) and the extension of it runs June 28th 2017 until June 29th 2018.(term end) so next contract will have been due to start June 2018. I get paid for the 39 week term and 5.3 weeks which gets split and paying equally each month.
2 days ago my headteacher payed for over £300 worth of training to start after the summer which is why I have quite shocked at seeing the advert.

As a fixed term member of staff, they have to give you the same pay and benefits as others who are permanent. They have to make sure you are aware of permanent jobs. You are aware of the jobs.

I tend to agree that everyone at the school doing the same job as you should have been informed about the jobs being advertised in more personal way but has the school actually placed the advert, or is it the Council? That might be the explanation.

It also seems odd that you have a contract that ends on 28 June. Did they not want you for the end of the summer term? Are the children not in school? Given that your terms and conditions are the same as permanent employees, other than a contract end date, you need to clarify holiday pay and how you achieve continuity of service. You need to sort this out rather than worrying about the advert in my view. However, you must apply. You could negotiate a start date for 29 June maybe??? Your Head wants to keep you.

If the OP is in Scotland then the 28th of June is likely to be the last day of term. I know a lot of our temp contracts are finishing on the 29th of June as our last day and staff will get a new contract in August.

Where as mine is fixed term to June 2019 so I will get paid over the holidays. But other staff won't because their contract ends on the 29th of June.

It would most likely be best to speak to your head to see what HR have told them.

I didn’t realise Scotland finished so early! However, trying to negotiate continuity of service is the priority and getting a job of course.

I guess I'm misinformed because I always thought non-renewal of a temporary contract was the same as making someone redundant 🤔

Worth having a chat with the head I think, but presumably you'll have to reapply. Certainly doesn't sound like they have any plans to get rid of you though.

My understanding is that is the case after a certain number of years. But I could well be wrong.

I know that after 2 years of continuous service they have to look at it. But our council finish the contracts in June and restart them in August breaking your service.
