Resignation retraction accepted! Will my salary and bonus scheme be affected?

Whilst working my notice period, the job I was going to took back their offer. I cried and was open with my boss (I couldnt lie I was panicked) about what had happened and she said I could stay. Im so grateful! She said, however, she had been close to hiring a replacement under different working hours and asked if I could do those hours. Happy to! Ive not signed anything yet but do you think they will treat me as a new starter and reduce my salary to that of a new starter? There is also an annual bonus scheme, do you think they would pay me pro rata for that from the date my employment would have ended?

No you have not left the business and remain in the same role so your continuity of service remains.

You should be fine on both counts. This happened to an ex BF of mine and he also stayed at original company. It's a great advertisement for resigning with grace just in case!

Your continuous service remains the same, but no one here can guarantee you that your terms and conditions aren't changing. You have asked your employer to let you retract your resignation, which they don't have to do. They've already made agreeing that retraction conditional upon you changing your terms and conditions in respect of working hours. They could similarly say it is conditional upon treating you as a new starter in respect of bonus arrangements, or salary.

I imagine they probably won't make any attempt to reduce your salary, but no one here is able to guarantee that. All we can guarantee is that as long as there is not a break in your employment, your continuous service for the purpose of accruing employment rights will be continuous.

For everything else, you'll need to ask your employer. Get their acceptance of your retraction and offer to allow you to remain employed on the new hours all put in writing, with confirmation of salary and bonus arrangements.

A bonus is normally awarded on the basis of contribution. It would be mean of them to prorata it to when you would have left the business, even though you continue to contribute in your role beyond that date (to the end of the 'bonus year' ).

Presumably as you applied for another job, things weren't going well in the company and those problems haven't gone away, so I'd still try and get another job in the meantime.

Thanks for your advise. I love my job, I simply wanted more money. I had been honest about that fact when I handed in my notice and when I had to announce my leaving to my colleagues. I made it clear it had nothing to do with not being happy in my role. The thing is, my money isn't even that bad, I just wanted more! The experience has taught me to be grateful of what I have. I want to stay in this job forever now! It was very scary. I nearly had no job at all and im a single mama to a toddler.

There is nothing wrong with being ambitious and wanting jobs with more responsibility and money. Don't let this put you off!
