I have been employed by the company for over 12 years.
Am I right in assuming I have the following legal rights : 12 weeks notice i.e. either I would need to work those 12 weeks and be paid for them or receive payment in lieu of notice
PLUS
12 weeks redundancy pay ?
Company have written to me quoting redundancy pay (12 weeks x salary) as a gross total and saying this figure is BEFORE deductions in lieu of notice ?
I have a consultation meeting coming up and will ask these questions but would like to know facts and I will go to CAB if I think they are not paying me the legal requirements.

Redundancy pay you can calculate using the GovUK calculator. It is capped so you may well find that it is not 12 x weekly salary but 12 x cap amount.

Notice I believe is as per your contract, which may be one week for each complete year or it may offer better terms. Statutory notice would be one week for every year worked up to a max of 12 weeks.

If they wanted you to leave immediately then I would expect them to pay:
12 weeks salary in lieu of notice +
12 weeks redundancy pay (which may be capped and varies according to your age).
The 12 weeks salary would be taxable as per usual (so Income Tax and NI)
The redundancy pay would not be taxable if under £30k.

Thanks Nannynick, that’s what I thought 12 weeks notice of the Redundancy plus 12 redundancy pay. The company seem to be overlooking the redundancy notice period !

Have you got legal insurance on your house insurance? They can provide useful advice if yiu need it and manyp eople often forget or don't realuse they have it.

Thanks bunbunny but I only have building insurance not contents so don’t think that would cover personal legal costs but I will check
