Am i being discriminated against

Hoping someone can offer some advice on here.

I have been working for my company, a charity for 6 years.

For the last 2.5 years have been on a temporary promotion position that for various reasons they're only just getting around to advertising as a permanent role.

I have been told today that the job will be advertised with a live in property as they 'need someone on site' to deal with emergencies.

We already have on call managers that deal with emergencies out of hours.

Background info, they've just employed a manager who will be a grade above me who turned down the property, didn't want to live on site, move their family etc.

Other sites have managers at other sites who want to live on site have been told.no they cant.

Other duty managers have to live within 30mins of site. Some do, some don't again inconsistent working conditions.

Basically lots of inconsistencies with this decision.

To move into the property, we'd have to relocate across town, rent out our own property, my husband would find it difficult for work and my dcs will be starting reception in spwtember at a greta local school. If I move they have no school place and id have to try and find them a place mid term. It would be very difficult.

Where do I stand on this? I feel like I'm being discriminated against because I have a family and cant just up sticks.

There have been other issues at work for me, bullying etc and this just feels like the last straw with a particular manager trying to make my life very difficult.

Any advice please?

It sounds like the want someone to live onsite and the previous manager declined so they are adding it into this job spec. Not discriminatory I don't think?

I work in HR but not yet formally qualified and I don't think this is discrimination.

There has been lot of talk recently about advertising for "full time only" positions can be indirectly discriminatory as it is more often then not, women who work part time for childcare reasons and therefore cannot apply for this role however, I don't think this applies here.

A man with a family would be in the exact same situation, surely.

I don't think its because I'm a woman, it was more due to my personal circumstances.

There are already 4 duty managers on my site covering out of hours issues.
The new manager has turned down the lodge probably for the same reasons I don't want to move in.
There are other similar roles to mine where living on site has not been a condition of employment.
The managers normally have to live within 30mins of site which I do.
There are also other managers on site who would potentially be happy to live on site but the head of service is insisting its attached to this role only.
I thought I might have more rights but possibly not I guess.b

Ahh okay sorry I assumed sex discrimination.

Again, I'm not 100% but I think for something to be discrimination it has to be one of the "protected characteristics" such as sex, sexual orientation, disability etc.

You could query with HR why this is a role requirement and if it could be removed but if not I don't think there is much you could do.

Not discrimination, no.

If you can't do the new job and there's no others available you should get redundancy in your current role.
