promotions and back to work

I started my current job in February 2017 - someone then joined after me doing the same role (a man). We are both at the same level of experience. I have been on maternity leave for 12 weeks. I am wondering if me being on maternity leave will mean that when i go back to work my male colleague will be above me for promotion purposes.

Common sense says yes as he will have dealt with my work for 12 months and therefore now have 12 months longer working with the firm and stuff. But, just wondering what you think?

I just wondered what the legal position is? Would seem unfair if the time wasn't taken into account i guess.

Surely there would be an interview and why assume he would necessarily would want to go for a promotion? Not everyone does.

its the type of job where everyone wants to - legal. The next step would be senior solicitor. There's no interview as such and it would not be one or the other as we both have the ability to at some point. Just makes sense that having effectively worked 12 months longer he would be able to apply faster.

If i was him i don't think i would be happy if I got promoted first having left him with all my work for 12 months.

Having 12 months more experience doesn't necessarily mean he is better for the role. You might be a better fit, or better at the job.

It depends how promotion is done where you work. I have never worked anywhere where time in role would have an effect; recency of experience might, but that will fade after a time. If one person had greater skills, ability and aptitude, then it would make no difference if they had 6 months less experience.
