90 day contract - holiday entitlement

Hello lovely mumsnettters! You were all v helpful on a recent post of mine regarding a recent job offer, I've been offered a 90 day contract working for a private college. My contract has come through today and there is no holiday entitlement according to this contract. I've previously been told that regardless of your amount of hours you are entitled to paid holiday leave. Someone kindly sent me a link to a gov website to figure it out but I couldn't make it work for a 90 day contract..

Would really appreciate your feedback, thank you.

90 days is 0.24 of a year. 0.24 of full years holiday of 28 days is 6.72 days they can't round down they must round up or give it to you in hours. So if you are working an 8 hour day 53.76 hours round up to 54 hours.

That all assumes 90 days includes weekends.

oh wow Lonecatwithkitten this is really helpful thank you! the 90 days doesn't include weekends, I will only be working weekdays during term time. How does this affect the above formula?

Statutory minimum holiday is 12.07% of time worked. So if you work 90 days you will accrue 11 days holiday entitlement.

Thanks Flowery do I not sign the contract until they've agreed this holiday allowance? I'm a bit appalled that they are trying to get away with zero days holiday...

Is there no holiday clause in the contract at all, or is there one and it says no holiday?

Sometimes, people try the old trick of “rolling up” holiday pay into the pay rate. I’m on a fixed term contract and when I joined my current company I agreed a rate, then turned up and was presented with a contract that was lower than my rate, “plus holiday paid on top”. I kicked up an almighty fuss as I had not agreed to this and thankfully it was resolved. Most companies I work for do add holiday entitlement to your contract and add a clause that you are expected to take it within the contract but if you can’t it will be paid at the end

wtftodo thats v interesting...I'm glad your situation got resolved. I really don't want to have to kick up a fuss but the rate I've agreed to is already low, so no holiday entitlement might just be a deal breaker here.

I think don’t assume the worst then. I’d suggest telephoning HR, thanking them for the contract but saying the holiday clause is blank, could they please reissue the contract with it completed.

If you are working term time most schools have a calculation for weeks paid which includes contracted holidays and bank holidays. For example the trust I work for we get 31 days holidays and 8 bank holidays. For staff who work term time or term time ie 38 weeks a year we pay them for 45.4 weeks which takes into account working time, holidays and bank holidays.

So in practice, you take the whole time salary for the grade, divide it by 52.14285 and multiply by 45.4.
