Can an employee have 2 different contracts for the same job?

Hi,

I work in the leisure industry. The facility was originally council run but was tendered out to a private external management company 15 years ago. In this time we were TUPED on our original T&Cs and this remained the same.

Last year the tender was up and was awarded to a different private management company. They made it clear from day one they would be changing our contracts after a year. I'm not sure it will be as easy as that...

My question is that they will be introducing new shifts soon. We have been told these new shifts will be on their t&cs.

Can they do this as it is the same job? Could we jeopardise our original contracts if we agree to their t &cs? Theirs are far more unfavourable.

If you agree to the new t&cs then those will be your t&cs, replacing your current ones. You can't have two lots.

If they want to change your terms and conditions they will need to consult with you, and seek your consent. If you do not consent, then they could potentially force it through but they'd need a good business reason for doing so.

There might be a good reason for changing the shifts, but that doesn't equal a good reason for changing other, unrelated terms.

As you were council employees previously, are you all in a union? Either way, the best thing you can do is respond together in a united front.
