parental leave denied

I work term time only and requested parental leave for 3 weeks as my daughter leaves school this year and we plan on going to Florida as it’s less money than school holidays. Anyway my employer has rejected it , stating I have enough holiday throughout the year. My argument is I am entitled to this leave and have spoken to Acas who agree with me. I should add that my job entails covering for others, sickness, days off to look after their children and also holidays! How do I deal with this?

It also states in the guidelines- to spend more time with grandparents, if you read my post earlier, i pointed out ,grandparents are coming with us! So I actually am covered by at least 2 points on the guidelines. Perhaps in hindsight I shouldn’t have put the holiday on the form, they didn’t need to know what I was doing in that time. Are you also saying that if someone uses it during the holidays to reduce childcare costs, that they must stay at home and not go anywhere?

If you had rtft you would know why op doesnt have 13 other weeks to do this.
Parental leave is to spend time with family/child. Where and why you are doing this is nobody elses business.
Op is legally entitled to it. End of.

OP is not legally entitled to take it when she wants, the company has a choice to delay it, with good business reasons and being an education service in term time is pretty good reason, they may not have handled it correctly but they do have a right to delay it.

Op requested it in plenty time. They did not offer other dates but refused it point blank and did not follow procedure at any time.
They have shot themselves in the foot.

I did point out that they handled it wrong, but some posters seem to think they can take the date they want.

No ok I haven't read the whole thread.

IF for whatever reason OP doesn't see her children during her 13 weeks holiday (can't imagine why she wouldn't) and for whatever reason this is the ONLY opportunity they get to spend time with their grandparents during the year then fair enough.

But I doubt that's the case - OP just wants a cheap term time holiday and is clutching at straws talking about grandparents coming in order to justify parental leave.

I'm all in favour of working parents rights but this is not the kind of scenario parental leave is intended for.

The point is its legaly due unpaid leave.
If you can afford to take it you do not have to give a reason.
If op has to take the holiday around her ohs work and her dds other upcoming commitmemts then thats nothing to do with anyone neither is where they are going.

This has been sai many times by many people but for the benefit of those who refuse to read I will say it again.

Parental leave was designed to allow parents to spend more time with their children.

It doesn’t matter if someone thinks they already have enough time with them. It doesn’t matter if that time is a cheap holiday or reducing childcare costs or travelling across thi Himalayas or whatever as long as that parent is spending time with their child they are entitled.

And the OP CAN spend time with her children during the holidays already so that's not really an argument. She just can't afford to do it in Florida.

You are wrong Celesti - in fact unless you have 6 weeks advance notification of your child being in hospital you can’t use it for that. (You could instead ask for Emergency Dependents Leave)

A 3 week holiday to Disney is an excellent example of what Parental Leave can be used for.

By using parental leave she can spend MORE time either her children on top of the holidays she already gets.
