Maternity discrimination?

Bit of a long story but happy to go into more depth if people need more info in order to be able to give me advice.
Ok so I went on maternity leave with DD1 in May - after just 12 weeks I fell pregnant with my son who I'm currently pregnant with.
Anyway, my maternity's cross over pay wise and I'm entitled to SMP from my employer for my current pregnancy. I was due to start my new SMP on the 17th of feb (he was notified correctly and given Mat b 1 form within the time frame I have to give him) yet he hasn't paid me! My colleagues where all paid on the 27th as per usual but he hasn't paid me my ten days maternity pay. I have emailed him on the pay day but he said he will revert to the accountant. It has now been 2 days and I still havnt relieved a penny. I have gone to Acas but I'm super annoyed and don't know how long this will go on for. Any advice people?

What makes you think it is discrimination? How many weeks pg were you on 17th Feb or is that just when your previous smp finished?

Are you certain you're entitled to SMP for the second maternity leave? Did you earn enough in the qualifying period?

Assuming you did earn enough, which actually if you were receiving SMP at that time I think you would have, it's a bit of a leap to assume that because your pay is 2 days late it's discrimination. An error is surely much more likely?

It's been two days since you should have been paid, it's a bit of a stretch to say it is maternity discrimination. Right now, it sounds like a simple mix-up in payroll or misunderstanding on someone's part. I think approaching ACAS already is a bit of an over-reaction. Is your accountant full-time or part-time - perhaps s/he hasn't even managed to see the email yet? Or isn't at work - like half the country? I would email your employer again, asking when you might expect to receive a reply and take it from there.

they have responded and said they will look into it not said for you to bugger off for your money sounds like an error to me

Sounds like a payroll error
