Bank Holidays - First Day of employment

Partyfops · 27/01/2018 22:26

I'm a sole trader and taking on an employee working 4 days a week.

We agreed that he would start at beginning of April. However the first day of April is a Sunday which is a non working day, the second is a bank holiday Monday. Do we agree start day of 1st or 2nd. Bank Holidays are included in holiday entitlement.

Im very new to this. Any advice please?

Technically, to be 100% fair, it's the 2nd. Think about if you were starting a new job what you'd think was fair. It's not the employees fault it's a bank holiday and if he or she started the week before, they'd be paid it. If they are currently employed, their old employer may be paying them up until the Sunday anyway.

However, loads of places would start them on the 3rd so you wouldn't be unusual to start paying them from the first day they start with you.

It would be totally reasonable for their start date to be the 3rd.

I stared my new job in January. On Tuesday the 2nd. Why would I expect my employer to give me a bank holiday when I haven’t done any work for them?! I would always expect to start on the first working day of a bank holiday week!

Give him a start date of 3rd, perfectly reasonable

Well, the reason it would be fair for the 2nd is that if they work 100% of the available hours in the week then they should receive 100% of the pay. If you start them on the Tuesday, they'll receive 4/5ths or 6/7ths of the salary, depending how the payroll works. They've worked the same hours as others for less pay as a result of the bank holiday.
