Advice on holiday pay

I work 2 days per week(15 hours) and am paid 3 weeks(6 days) holiday pay per year. My boss wants to reduce this to 4 days per year but looking on the Acas website it says I'm entitled to 11.2 days per year. Can anyone please confirm if this is the case?

Using the .gov calculator you should get 84 hrs a year for a 15 hr week

Thanks that's exactly what I got, was worried I was missing something because my boss was adamant she was being overly generous laying me 6 days(45 hours).

That is a statutory requirement so if they haven't provided this and you are contracted for 15hrs a week (zero hours or less hours contracted does make a difference) then your boss is breaking the law and owes you this pay.

Thanks again. I've never been given a contract - it's a small business but have worked 15 hours or more a week for nearly 4 years. Wonder if it's the lack of contract that means she thinks she can do this?

Entitlement is 5.6 weeks per year (1 week would be your 2 days) so you haven't been getting your full amount in the first place

The legal minimum for a FTer is 20 days (or 4 weeks) plus the 8 Bank Holidays.

On a two day per week rota, that would equate to still 4 weeks - a total of 8 days. Plus the pro rata of the Bank Holidays too, which is 3 (rounded down from 3.2).

So you should have 7 days.

What days do you work? It could be you're getting the 11.2 days but a chunk is taken by bank holidays.

I work two days a week, and my company give me 11.5 days. Statutory is 11.2 days, but they told me holiday days should always be rounded up.

I agree you should be entitled to 11.2 days per year but that includes bank holidays so if you work Mondays normally and have those off when its bank holiday that's included if that makes sense.

So if you take 6 bank holidays you are only entitled to another 5.2 days of your choosing.

Phew napqueen I was worried at 7! Think I might need to query the lack of contract first - I got given a job description a few years ago which did have my hours on it but no formal contract.

Should be 11.2 days which can be inclusive of bank holidays. Do you get bank holidays as well as other days?

Have you always worked the same days?

Im pretty sure that if you have worked the same shift pattern for over a year you cant be classed as "casual" which is what i would say non contract is.

I work mondays but don't get them off when it's a bank holiday I work as normal - apart from over Xmas.

Then your Bank Holiday allowance (3/3.5 days) should be added to your Bank Holiday entitlement.

Im pretty sure most places pay double time for bank holiday shifts too.

Yes, same days for nearly 4 years and extra hours when the business is busier. God - think in the new year I need to look for a new job!

Based on this if you have accepted the job based on the JD and have been working to that for the last 4 yes then that is your contract. If the JD said permanent staff member 15hrs a week then that is your contract.

There is no entitlement to paid bank holidays or for extra pay for them either. They can be included in your normal holiday entitlement.

Thanks for all the advice. I think because the previous owner didn't pay any holiday pay at all my boss thinks she is being very generous.

so if you think of this as you work 1 day a week you would get 5.6 days
2 days 11 and a bit (5.6 *2)
