Hi all, apologies for the essay!
Having worked at my current employment for just over 3 months i handed my notice in. At the time i was told 1 month was fine, then a few days later the director then told me it was 3 months and I would not be going anywhere before that time. At this meeting he called me disloyal and told me how much money was wasted getting me. He is a bully who ignores or shouts when minor mistakes are made. I am not in a senior role and cannot handle the anxiety of being there and have a job lined up. i'm now at the end of the 1 month I initially handed in. What would the repercussions be if i did not return?

What does your contract say re-notice period?

Your notice period should be defined in your contract. Stick to that.

Have you been paid yet?

A weeks notice is deemed reasonble.

If the other job wont wait just leave now no one will drag you back to your old job.

In my contract at work it says 3 months. I moved not long ago and stupidly lost my version of the contract and stated as such when i handed my notice in and it was confirmed at the time that 1 month was fine. It took a few days for them to state it was 3 months and not 1.

Is the contract they have signed by you? Also did they email you the contact when you started? Do you have an electronic copy?

I do not have an electronic copy unfortunately. I have seen the copy I originally signed but the last page in which i signed is on a different page to the one discussing notice period and I have seen management alter contracts of other employers.

Your current Boss op sounds like my old boss he was a total arsehole one min he would be nice wouldn't do a great deal in terms of what he was suppose to do job wise and then next he would be nasty piece of shit saying you weren't doing your job everyone finds you miserable blah blah blah nasty nasty man

I would leave they can't force you to work 3 months if you've already got another job go the worse they can Make you do is pay back any owed money but really is it worth making yourself ill any more leave and never look back good luck in your new job Wink

I would just say "this is the date I'm going" and leave. In theory they could try and sue you but this is very unlikely unless you going is causing them some big financial loss. Do you have any evidence around them agreeing to you leaving a month after you handed your notice in as that would be very helpful.

If you only worked there for 3 months did they even confirm your probationary period?

Often notice periods are much less before probationary has been successfully completed. Often it's a week either side then moves to 1month or 3 months, but that's just an example.

If they never got round to confirming your employment you may be in the clear.
