is this a redundancy situation?

My team is undergoing restructure, and at a particular grade (mine!) there is a high chance there will be one post less than now.

Our team is part of a large organisation, so there will undoubtably be other posts that could be argued to be suitable to whoever doesn't get one of the new posts.

In this situation, would the 'role less' person have any ability to say they didn't want an alternative role? If that was the case, would it be a redundancy situation or does that not apply if an alternative post in the wider organisation is offered?

If there is a reduction in the requirement for those particular posts, then it's still a redundancy situation, because redundancy applies to a post, not to an individual.

However if an employee whose post is made redundant is offered a suitable alternative and refuses it, he/she would forfeit his/her right to a redundancy payment.

If there is a role which the organisation believes may be suitable, the employee can have a trial period to establish suitability. if not suitable, then redundancy (including pay) still applies. However that doesn't mean the employee gets to reject a post he/she just doesn't fancy as being unsuitable, if that makes sense.

It makes perfect sense, thank you.

In our case, I suspect that whoever doesn't get one of the remaining posts will be offered a suitable post elsewhere. They may not fancy that post, but it will be the right grade/skill/location/responsibility etc, so redundancy is unlikely I guess.

Yes, the post will be redundant, but in our case no person is likely to be.

Thanks Flowery
