urgent advice needed please!

wasnt sure if to post this under employment or legal,but i guess best place to start is here!

dh ahs just rang me from work,and is seriously on the verge of handing in his notice.

one of his supervisors is constantly having a go at him.every day they are argueing and today dh's supervisor said that dh if dh doesnt do as he is told hes facing the sack.supervisor has sprung it on dh that he has to work this weekend.dh said theya re supposed to get 2 weeks notice of this.supervisor said "work or go to the job centre"

yesterday he told dh that he wouldnt be working in the warehouse (he works for gelert as a tradeshow organiser) but would be driving to warwick castle instead.dh didnt get home until 10.30 last night.

he is on annualised hours,so doesnt get paid in money for extra work,but when dh asks to take time off supervisor has a go,despite previously complaining that dh has over 100 hours in the bank!

dh said he has just had a massive arguement with supervisor,as he is always having a go at him.also last weekend when dh worked,s.v refused the lads time and half on the sunday,saying you can work more hours on the saturday and less on the sunday.and because some of them didnt agree with this,hes given them a date for a disaplinary hearing!soem are now on their last chance before being sacked just for standing upto this idiot.

what i need to know is where do we stand if dh walks out?i mean could he take s.v to tribunal or whatever it is over him constantly harrassing him?dh said he feels like s.v is provoking him into walking out.he feels like hes being forced out of teh job.

also if he did hand his notice in,would be entitled to help with the rent and council tax as we have 5 kids and another on the way (2 of our kids are disabled)

sorry to waffle on,but didnt know where else to turn.

The supervisor has to have a supervisor - go to the next person up the ladder. Your DH needs to put everything in writing, in a calm, objective way - be factual and accurate, give dates of what happened when, any supporting evidence (witnesses?), and put in a formal complaint - its workplace bullying, and nothing else. Does DH have a contract of employment? Does it specify place of work and hours?

I'm nte sure but before you get the sack you need to have verbal & written warnings usually (unless its gross misconduct). Don't hand in notice !! Sounds along the lines of workplace bullying t me which is not acceptable. He needs to get everything thats happened down in writing with witness statements where poss.
Is he in a union - get legal advice ASAP

Hope someone can give you more informed advice

its in his contract the hours they work and also about 2 weeks being giving by them on any other times they are needed to work.

hes a fireman aswell (retained) so is in a union with them,he said they cover his normal employment aswell.

there will be loads of witnesses and i should think some will back him up,but alot are scared stiff of this s.v so will probably keep quiet.

If he hands in his notice due to his numpty supervisor he would have a case based on this Constructive dismissal .

I had prob's with my proj mgr, so saw the mgr above him to sort it out, had printed out all the company policies on work place bullying and types of dismissal etc... to back me up, they ended up moving me to another department.

As it appears a lot of the employees are being bullied by this guy, perhaps a group meeting with supervisor's manager so that it doesn't look like only one person is doing the complaining/reporting.

kiwi thanks for the link.will print it out for dh.

i jsut rang him to tell him what hassled and whizz said and he said he is going to see the woman in personnel and ask how he goes about leaving.

if he does leave there it also means he leaves the firebrigade as he is on call from gelert,and we live too far away from the station for him to carry on working there.

i cant believe its come to this,hes usually really strong willed,and for this to have got to him to the point he wants to leave is unbelievable.

the sv does pick on the others,but more so on dh as sv is welsh and dh is english.sv has a go at him and often speaks in welsh when he knows dh doesnt understand.this has been brewing now for about a year,but i guess today has been the worst day for dh so far.

I'm not ssure but I think Constructive Dismissal is quite hard to fight - so he needs to get advice BEFORE he hands in notice
