Handing in notice at work and holiday pay...

Following on from my "Dh has an interview thread" I'm happy to say that Dh got the job, yipee!

So he now has to hand in his notice at his present job. He's been told that he only needs to give 2 weeks notice this will take him to the 6th of April, well that's 2 weeks from today anyway.

Now dh's holidays in this present company run 1st April-31st March.

His staff handbook says that on termination of employment you may be entitled to a payment in lieu of any accrued but untaken holiday entitlement.

Now bearing that in mind, If he hands in his notice now and his last day of working is in April will he get paid for the 4 weeks holiday that he should have received form April onwards?

Anyone know?

He'll get 1/12 of his holiday pay won't he?

I wouldn't have thought he's entitled to any more than the proportion of holiday "earned" for the new year, and it may well be that part-months (especially only 5 days) don't count. Should be in his contract somewhere.

But he would get any unused holiday from the year just ending.

He doesn't have a contract, long story, but we do have this staff handbook. He doesn't have any holiday left over from the year just ending it's all been used up.

I mis-read.

Catilla is right IME. In the case you state where he will be employed for only one-sixth of one month of a new holiday year, he could only possibly expect 1/72 of his holiday pay!

ok, it's not vitally important I just wondered what would happen that's all.

His new job want him to start next week but he'll have to work his notice first.

probably only work in full months, therefore nothing for april. may get any time owing owed though.

Should be calculated on a daily basis so he will, at most, be entitled to holiday accrual for 6 days.

Again, depends what it says in the policy or handbook as to how they calculate it.
