Part time worker - annual leave entitlement

I work in a very small business - husband and wife team and myself. I currently work 15.5 hrs a week, sometimes more.

I don't have a contract but was told from the start that my holiday entitlement is 12 days. Recently l was informed by a friend this isn't right and l should get 16 days as set by the government guidelines.

I have looked into and it does seem that 12 days isn't right - see screenshot. My dilemma is how on earth do l approach my bosses with this? Obviously more leave would be nice(!) but l don't want to cause problems as it's such a small workplace. Any advice from HR bods would be much appreciated.

Realised l posted the wrong screen shot earlier! The gov.uk site shows me as being entitled to 86 hrs and 48 mins as many of you have also pointed out already.

So ideally my annual leave should be worked out hourly rather than by days? Still not sure how l broach this with my boss?!

I guess if l'm ever given a contract, l could try to raise it then, tho l've been there nearly 2 years so don't think a contract is going to be forthcoming any time soon!

Thanks for everyone's advice and input - it is much appreciated Smile

In total, you are legally entitled to a minimum of 5.6 weeks of holiday at 15.5hrs off on each of those weeks. This may include bank holidays.

When I did 15 hours a week my entitlement was 12 days a year. That was with a company giving a bit more than legal minimum and included 40% of the bank holiday allowance though I didn't work any. These were full days.

With no full time employees it is difficult to prove anything but pp are right that your leave should be effectively 86.8 hours off.

It does not matter at all how many bank holidays fall on your normal working days. That doesn't affect the leave calculation - nut when a bank holiday does fall on a working day that can be reckoned as a day of annual leave that you must take on that day if you don't work when you otherwise would have.

12 days is the correct number of days of annual leave for you to be entitled to if whenever you work you do a full day of work (it works out assuming a 36 hour full time week which is reasonable).

If your working days are not at least 7 hours long then your leave should be taken as a number of hours coming off a total of 86 8 hours rather than a number of days coming off 12.
