Wages/maternity pay

I was wondering if anyone can help with a maternity pay query.

I started my maternity leave on Friday 11th November, I'm paid a salary on a monthly basis (last working day of the month) and contracted Monday - Friday.

The SMP that I have been paid is correct (2 weeks + 5 days) but I worked 9 days in November so assumed I would be paid 9 days wages - salary / 260 (working days through the year) however my employer has paid me - salary / 365 * 11. The difference is over £100 in their favour.

Does anyone know how this should be calculated? Am I being unreasonable? Would you dispute this with your employer?

Does it say anything about how pay is calculated in your contract?

365? Is that something to do with holidays, are you part-time?

Doesn't specify in contract.

365 - number of days per year.

Don't work weekends so I presumed my daily wage was 52*5 = 260 working days per year.

Should mention that sick pay is discretionary and I had a day off sick in October ( first day in 4 years) and they deducted a days wages based on 260 working days per year not 365.

Hope that makes sense

My company pay our enhanced may pay weekly as SMP is weekly. Therefore my first month of may pay I actually got 4 weeks pay, the following month 5 weeks pay. Perhaps your's is similar? I was used to getting paid monthly so it's kind of annoying it fluctuates!

When my pay was done like that (I also started mat leave part way through the month) they did it based on the actual days worked. I don't work weekends either. They did salary / 52 weeks a year /5 days per week Definitely query it with your payroll department, at least to check how they worked it out. Be nice about it though, unless they've cocked up your pay in the past :)

I think it is up to individual employers how they calculate part months, so as long as what they're doing isn't completely illogical (which it isn't) and they use the same calculation for all affected employees then it's fine.

Where I used to work it was done by taking monthly pay and dividing days worked by total days in that month. I think that was less fair than the method you've described, because someone who worked 9 days of February would get more than someone who worked 9 days of November!

I asked accountant and he came back with the amount my salary was paid. (Salary/365 X 11)

My SMP part of wages was correct just I think the amount i was paid for actually working is wrong.

You'd think after 7+ years they'd not be such t**

I would mention about the sick leave that was deducted as additional pay should be calculated in the same way as deductions.

If you don't work weekends, it makes no sense to calculate it on 365 days, just on the number of days that you work. If any different, it could possibly be annual salary/12 and then times by the number of days worked/total number of working days in that month.

Is your salary based on an annual rate, or an hourly rate?

To get a weekly rate for an annual salary I'd divide by 52.1429.

I get an annual salary. I worked 9 days so presumed I'd get 9 days pay (salary divided by 260(52 X 5)). But they've paid me salary/365 X 11 as I worked up to the 11th of the month. They've just worked out the cheapest way for them to pay me Angry
