Signed off with pnd can they sack me >>>

I hav worked for company for 7 and a half years. I have aa good sickness/absence/timekeeping record. I was signed off at the end of october when my paid mat leave finished. They have said I will be paid 6 weeks full pay, 6 weeks half pay and then SSP (I only work 17 hour pw so i'm not sure how much SSP I'll get) Can they sack and if so after how long.

They can't sack you because you're sick.

I dont think they can sack you as such but I was signed off for 6mths with PND then was suggested I medically retire by the psychatrist which I discussed with work and they were happy to do.I think as long as they can keep in contact with you and your gp then they have no grounds to sack you for a genuine illness.

You should read through your contract, any policies etc just to see what it says about informing them, staying in touch, that kind of thing.

you can be 'sacked' for being off sick, with a sick note or not, under capability.

however, if post natal depression is to be regarded as a pregnancy related illness then no you can not as that would be sex discrimination.

if you google it a bit there are lots of cases that have gone to court regarding this.

sorry to hear about the PND. Unfortunately your employer can absolutely dismiss you on grounds of capability. there may be an absence policy that sets out the process that will be followed leading up to a decision about your employment. PND is not covered under sex discrimination legislation. Depression may be covered by the disability discrimination act depending on your prognosis. Your best bet is to keep them informed, keep sending in sick notes and be co-operative about meetings. hope you feel better soon.

thanks all, i amkeeping in touch with them but sickness policy is very ambiguous in my company

Contact ACAS, they know everything about employment law and are v helpful.

Just Google ACAS, and the website and contact number will come up. I think you are protected in some way, whatever your company sickness policy says,but ACAS will know. Hope this helps
