Tribunal claim - do I need to submit my arguments in response to Respondent's arguments?

Sorry basically full story is this:

  • Submitted a claim 3 months ago, claiming unlawful deduction from wages, holiday pay, and unequal treatment of part-time worker (due to way final wages were calculated)
  • Response received in time from Respondent around 5 weeks ago
  • Preliminary hearing next week

Respondent is claiming I am not a part-time worker (I had a term-time contract), and also that the holiday pay is out-of-time because there was an unbroken period of more than 3 months where I took no holiday (my argument is that because my holiday pay was incorporated into my monthly pay that this is irrelevant).

I may be able to present the case as a simple unlawful deduction from wages case, on the basis that they should pay me for the number of days I had worked as of the end of my contract. But I am not sure if this is a new argument and if so there is a time limit for submitting it?
