I've been off work for fair few weeks now with hyperemesis. I ended up in a half pay situation which ended on 13th this month. So for 13 days I should of been getting half pay AND statutory sick pay, and for the rest of the month just statutory sick pay. For the last 2 weeks I've not been paid any sick pay. This is because my manager did not tell me to bring my new sick note in, if I bring it in do you think they'd re-pay the days I do have an official sick note?? Can I claim this sick pay from somewhere else? I have £362 to live on for the whole month, shocking the way they're treating a pregnant lady really. Sad

no clue BUMP for answers

p.s. being pregnant is irrelevant, if you're ill, you're ill.

Unthoughtknown · 27/08/2015 07:33

Yes they should back date it

Penfold007 · 27/08/2015 07:35

It is always the employees responsibility to provide sick certificates on time so SSP can be paid. All you can do is hand it in now and apologise, hopefully you pay department will pay it.

Thanks for answers.

Unfortunately I think being pregnant is relevant because I'm not being put down as ill I'm being put down as pregnancy sickness? I don't know if that affects it. Anyway will give them a call today and see what happens.

This doesn't answer your question but asks another one that the HR bods may know - if a company pays extra sick pay (so the half pay situation) do they have to pass on the SSP to the employee as well?

If have thought they would keep the SSP themselves and just pay the half pay to the employee.

The wild, mine do. (The NHS)

It is more usual for any occupational sick pay to be inclusive of SSP but any employer's policy ought to be clear on that. Any sick pay entitlement will be dependent on provision of medical certificates after the first week of sickness.

Pregnancy is irrelevant to sick pay entitlement unless the employer's policy specifies differently.

Why did you think your employer should have to tell you that you need to provide the sick note? The whole point of a fit note is that it certifies your fitness to work (or otherwise) for a specific date range. If your old note ran out and your new note wasn't given to them then it's understandable that you haven't been paid.

They haven't 'treated a pregnant lady' any differently to any individual who hasn't followed procedure. Confused

I expect you can have it back paid but they'll make you wait until the next pay run as it's your error.

NHS do pay 50% wages + SMP, capped to full pay.

idontknowmyusernameanymore · 28/08/2015 00:16

I'm not saying the sick note thing has treated a pregnant lady why differently, just ongoing issues with my manager and how she is treating a pregnant lady. Not going to 'drip feed' anyway.

And the NHS can just pay sick pay, they don't have to pay half pay too, they're not for me anymore anyway.

Yes, they can revert to SSP only. I would get that sick note in ASAP.
