Hello, I am leaving my current job and have got a new job, current boss and HR know I am pregnant, my new job doesn't know. My new employer is going to talk to my old HR to finalise some details on contract, my question is will HR tell my new employer I am pregnant or is that confidential? I am in the education sector if that helps.
Any advice, my employer has completely screwed me over already :(

It would be a breach of your confidentiality if they did and very unprofessional.

Could they retract the offer now? I have signed the contract just waiting on DBS clearance.

No they can't retract the offer, absolutely not.

It would be a breach of confidentiality if HR tell the new employer, although I can't imagine why they would. But even if they did, the new employer can't change their mind because of that.

Thank you. I have just been burnt so badly since telling my employer I am pregnant, I don't know who to trust. I wont be getting any maternity pay even though I have worked solidly since becoming a teacher 7 years ago. My life is such a mess right now.

Although they shouldn't they might not think about it and assume the new job already knows, so it might be worth a chat with your HR to clarify before they mention it in passing.

Spoke to HR and they said they did not tell my new school.
to explain a bit more- when I told my current school I am pregnant, they were not happy and said how much hassle this causes them, they then retracted all the verbal offers of permanent position etc and now I will be finishing well before my qualifying week, hence ensuring I get no smp. I am gutted and have chosen to take this further, but not a good position to be in as a pregnant woman in this so called 'caring profession'.

You will still be entitled to maternity allowance, which is the same pay as smp but through the job centre.

Nope they didn't pout it in writing and now denying it ever happened. Maternity allowance will be about 138 a week. I should be getting my full maternity pay of 90% for x months etc.

So, will you be on ML before you start the new job, or is there a gap which means you won't have continuous service?

I'd speak to the new school and tell them your old one is being difficult about your end date. You might find the new school is prepared to start you early so you can have continuous service. My head would.

You're going to have a thick skin if you haven't told them and you're going on ML as soon as you start though. Nothing "wrong" with what you've done but is going to cause the new school a lot of hassle.

I won't be going on ml for a few months after I start. I will tell them soon. New school have already tried to start contract early but hr wouldn't allow it as it is currently going through legal process at my old school. I never would have done this to new school if old school hadn't royally screwed me. I was hardly gonna announce my pregnancy at interview in new school was I?

It doesn't matter if they put it in writing - I hope you are taking this to an employment lawyer who specialises in maternity rights.

The new school can put what every date they want on your new contract Confused

If your contract at the old school ends on x date, there's nothing to stop your new one starting the next day. would be unusual for there to be much contact between the two HR depts beyond references TBH.

As far as I know, if you have continuous service in the same LEA, even in two different schools, you're entitled to your full maternity pay. This might not apply if it's an academy.or free school though - I'm not sure. Worth checking with your union.

That's true jalopyjane, except it doesn't have to be the same LA, any LA teaching position will get you continuous service. Most academy's recognise it too.

Op's problem is that she'll have a break in service.

I will have a break in service. New school spoke to hr because although they wanted to start my contract early they technically have no job for me til September. So I would have been on unpaid leave, which again results in no maternity pay. Yes I have a solicitor, but it's my word against the heads.
