If you give more notice than your contract requires, can they make you leave sooner?

Trying to work out how to give notice to our best advantage.

If you only need to give a week but give a months notice, can the employer force you to leave earlier with no pay? Does the resignation mean that they cant sack you for any reason other than gross misconduct? For example they cant suddenly say "you're time keeping is crap, we are sacking you"?

Will call ACAS in the morning but would value any info anyone has, thanks.

Do you have a reason for wanting to give longer? If I was in that situation I would just wait 3 weeks then give the required 1-week notice.

You would probably get better advice if you moved this to Employment Issues, there are some HR people there who actually know their stuff (which I don't).

Yes, and its financial.

I just wondered if an employer can say "You are only required to give a week so you are leaving after a week" even if you gave a months notice.

His boss is a prick in case you hadnt worked that out! He also wants to give longer notice because his colleagues, who he likes and respects, will have to pull up his hours until a replacement is found.

I would give a week. I know someone who gave 2 months when only a month th was required and the as told to leave after a month so it can happen.

Yes once you have given notice your employers can require you to leave by the given time period.

Spoke to ACAS and yes thanks you are right!

I suspected that might be the case but having worked it out, I think we will be ok financially.

There isnt much we can do about his colleagues and to give you an idea of what its like there, since he started they have lost......2 supervisors (will be 3 when H leaves) 1 Dept Manager, 1 OPs Manager, 4 general assistants, 1 specialist contractor who has blacklisted them and a couple of temps who didnt even manage a full day.

This mass exodus doesnt seem to have been flagged up anywhere, but its all down to the total mismanagement of the GM, who has managed to alienate most of the staff apart from a couple of favourites, who coincidentally are as incompetent as he is!
