Bank holidays when work part time

So I'm back at work on a 4 day week mon-thurs (hate that it's called part time... as if!). Does anyone know what happens to my bank holidays that fall on a Friday? At my last place of employment, my boss (who did the same hours/days) took them as days in lieu... is that standard employment law or a special benefit she received? Thanks for your thoughts...

depends if they give bank holidays on top of the statutory holidays as employers can include them as part of the statutory holidays rather than giving them in addition.

a person working 4 days a week is entitled to 22.4 days holiday - bank holidays can be included in that or in addition depending on what your contract says

www.gov.uk/calculate-your-holiday-entitlement

Many thanks dementedpixie

I'm assuming that's calculated to include all bank holidays though - and I already get the ones that fall on a Mon-Thurs. I guess I'll have to go with whatever HR come back with although they don't really seem to know.

I was on 25 days plus bank holidays when I was full time but have been told I've got 20 days now I work a 4 day week as it's been pro-rata'd.

that 22.4 days holiday is the statutory minimum so they cannot give you less than that. That may or may not include the bank holidays. Have they said they will give pro-rated bank holiday entitlement too.

so maybe they give you 20 days holiday (which is 4/5 of the 25 days holiday) plus 4/5 of the 8 bank holidays which would be 6.4 days. You will have to check with them though. They cannot give you less than 22.4 days though.

Depends on your contract, there's not an automatic entitlement to get bank holidays off for anyone. Bank holidays can also be used to count towards the minimum holiday entitlements.

Where I work, it's normal for full time employees to work Mon - Fri, and the contract for full time employees is 25 days per year off plus bank holidays. That's pro-rataed down for part timers, so part timers aren't entitled to time off for every bank holiday. Someone working 4 days a week at my workplace would essentially be entitled to 4/5ths of the bank holidays, and part timers have to count and book bank holidays as normal holidays to avoid disadvantaging part timers who don't work Monday's.

But, really you need to check your contract and your company policies to check what they say about it as there's not a standard answer to this.

dementedpixie · 23/03/2015 13:18

so full timers got 25+8 = 33 days per year
pro-rated at 4/5 would give 26.4 days

Check the contract as not all employers work the same but bear in mind they can't give you less than 22.4 days

EeyoresTail · 23/03/2015 13:21

Are you asking if you would get Easter Friday paid if you didn't work? It's not your contracted day so I doubt it.

ShadowStone · 23/03/2015 13:21

X-posted, sorry.

It would make sense if your bank holidays were pro-rataed down too. As dementedpixie says, 20 days holiday is below the statutory minimum, so presumably you still have some bank holidays in there somewhere.

ShadowStone · 23/03/2015 13:26

Yes dementedpixie, someone working 4 days / week at my work would get 26.4 days holiday altogether per year, and any bank holidays falling on their working days would be taken out of that 26.4 days.

And yes, essential to check your contract and company policies.

Northumberlandlass · 23/03/2015 13:28

I used to work Mon - Thurs and my contract stated I got X holidays plus bank holidays on top. Because I didn't work a Friday, Good Friday didn't make any difference.

dreamingaboutcheese · 25/03/2015 15:20

That all makes lots of sense - thanks all. I'm trying to see our policy at work but keep getting met with silence so at some stage I may just present them with an idea instead Smile

Check previous threads on this point. I think the vast majority of employers will offer you 20 days plus 0.8 of the 8 bank holidays, so 6.4 (which most would round up to 6.5) but you have to take a holiday if a bank holiday falls on your normal work day.

Regardless of how Christmas and New Year fall, there will always be 4 bank holidays on Mondays. The other bank holidays are Good Friday (obviously always a Friday), the New Years Day, Christmas Day and Boxing Day. Depending on how those 3 days fall, it could end up "costing" you your annual leave (i.e. you might have to use 7 days some years to cover Mon-Thurs bank hols). However, if you get any choice, and can work Tues - Friday, you will only ever have to use a maximum of 4 days to cover bank holidays, so you will always "gain" annual leave as you won't have to use all 6.5 days.
